9 To amend, on a temporary basis, the Homeless Services Reform Act of 2005 to clarify the
10authorization to share certain data within the Department of Human Services and between
11the Department of Human Services and other District agencies to facilitate the
12determination of eligibility for federal and District health and human service programs;
13and to amend the Data-Sharing and Information Coordination Amendment Act of 2010 to
14      clarify the definition of the term “agency” and the intent of the grant of data system
15      authority.

17BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
18 act may be cited as the “Health and Human Service Programs and Benefits Eligibility and Delivery
19 Data-Sharing Clarifications Temporary Amendment Act of 2026”.
20Sec. 2. The Homeless Services Reform Act of 2005, effective October 22, 2005 (D.C. Law
21 16-35; D.C. Official Code § 4-751.01 et seq.), is amended as follows:
22(a) Section 9(a)(7) (D.C. Official Code § 4-754.11(a)(7)) is amended by striking the phrase
23 “consistent with the confidentiality requirements of District and federal law;” and inserting the
24 phrase “consistent with the confidentiality requirements of District and federal law, subject to the
25 authorized uses and mandatory disclosures of such records and information in accordance with
26 Title I of the Data-Sharing and Information Coordination Amendment Act of 2010, effective
27 December 4, 2010 (D.C. Law 18-273; D.C. Official Code § 7-241 et seq.);” in its place.

28(b) Section 12(12) (D.C. Official Code § 4-754.21(12)) is amended by striking the phrase
29 “consistent with the confidentiality requirements of District and federal law;” and inserting the
30 phrase “consistent with the confidentiality requirements of District and federal law, subject to the
31 authorized uses and mandatory disclosures of such records and information in accordance with
32 Title I of the Data-Sharing and Information Coordination Amendment Act of 2010, effective
33 December 4, 2010 (D.C. Law 18-273; D.C. Official Code § 7-241 et seq.);” in its place.
34Sec. 3. The Data-Sharing and Information Coordination Amendment Act of 2010, effective
35 December 4, 2010 (D.C. Law 18-273; D.C. Official Code § 7-241 et seq.), is amended as follows:
36(a) Section 101(1) (D.C. Official Code § 7-241(1)) is amended by striking the phrase “or
37 instrumentality of the District of Columbia government” and inserting the phrase “authority, or
38 instrumentality of the District of Columbia government, or any subdivision of such agency,
39 department, unit, authority, or instrumentality” in its place.
40(b) Section 102(a) (D.C. Official Code § 7-242(a)) is amended by striking the phrase “In
41 accordance with section 103 and without” and insert the word “Without” in its place.
42Sec. 4. Fiscal impact statement.
43The Council adopts the fiscal impact statement of the Chief Financial Officer as the fiscal
44 impact statement required by section 4a of the General Legislative Procedures Act of 1975,
45 approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).
46Sec. 5. Effective date.

47(a) This act shall take effect following approval by the Mayor (or in the event of veto by
48 the Mayor, action by the Council to override the veto) and a 30-day period of congressional review
49 as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December
50 24, 1973 (87 Stat. 813; D.C. Official Code § 1-206.02(c)(1)).
51(b) This act shall expire after 225 days of its having taken effect.
