To amend title 18, United States Code, to establish birth tourism as an offense, and for other purposes.
1.
Short title
This Act may be cited as the   No Deliveries Act  .
2.
Birthing misrepresentations
Section 1546 of title 18, United States Code, is amended—
(1)
in subsection (a)—
(A)
by striking  or fact—  and inserting  or fact; or ;
(B)
by inserting before  Shall be fined  the following:
Whoever knowingly enters the United States for the purpose of giving birth to a child whose parents are not nationals or lawful permanent residents of the United States and misrepresents such purpose—
 ; and
(C)
by inserting  not less than 10 years (if the offense resulted in such child being born in the United States) or  before  not more than 25 ; and
(2)
by adding at the end the following:
(d)
Notwithstanding any other provision of law, a United States district court shall have jurisdiction to enter a judicial order of removal at the time of sentencing against any alien who is convicted of an offense under this section.
