R. 9949 IN THE HOUSE OF REPRESENTATIVES July 27, 2026 Mr. Barrett introduced the following bill; which was referred to the Committee on Energy and Commerce A BILLTo require the Secretary of Health and Human Services to conduct a study on the impacts of arsenic, cadmium, mercury, and lead in infant formula on infant health and establish standards for regulating the content of such substances in infant formula.1.Short titleThis Act may be cited as the Safe Baby Formula Act of 2026 .2.Study on infant formulaNot later than 1 year after the date of enactment of this Act, the Secretary of Health and Human Services shall complete a study on the impacts of arsenic, cadmium, mercury, and lead in infant formula on infant health.3.Prohibition of toxic metals in infant formula(a)Action levelsNot later than 90 days after the date of enactment of this Act, the Secretary of Health and Human Services shall establish evidence-based action levels with respect to arsenic, cadmium, mercury, and lead in infant formula.(b)Requirements for action levelsIn establishing an action level under subsection (a), the Secretary shall consider—(1)the feasibility of complying with such action level;(2)the capacity of the Department of Health and Human Services to enforce such action level for food imported, or offered for import, into the United States; and(3)the impact of such action level on domestic food security.4.DefinitionIn this Act, the term infant formula has the meaning given such term in section 201(z) of the Federal Food, Drug, and Cosmetic Act ( 21 U.S.C. 321(z) ).
