R. 10005 IN THE HOUSE OF REPRESENTATIVES July 30, 2026 Ms. Scholten (for herself, Mr. Subramanyam , and Mrs. Grijalva ) introduced the following bill; which was referred to the Committee on Energy and Commerce A BILLTo direct the Assistant Secretary of Commerce for Communications and Information to conduct a survey with respect to data center resource consumption, and for other purposes.1.Short titleThis Act may be cited as the Data Center Resource Disclosure Act .2.Data center resource consumption survey(a)In generalNot later than 180 days after the date of the enactment of this Act, and annually thereafter, the Assistant Secretary shall—(1)conduct a survey through which the Assistant Secretary shall request the operator of each data center located in the United States to provide, on a voluntary basis, information on—(A)the energy consumption of such data center for the preceding 1-year period; and(B)the water consumption of such data center for the preceding 1-year period; and(2)provide an opportunity for individuals and entities, including public utility boards, labor organizations, State regulatory authorities, and public interest organizations representing consumers, to submit comments in relation to such survey.(b)Publication of resultsNot later than 180 days after conducting a survey under subsection (a), the Assistant Secretary shall—(1)publish on the primary website of the National Telecommunications and Information Administration the results of such survey, which shall include—(A)the presentation of such results using an interactive map of the United States;(B)an identification of each data center with respect to which complete information was not provided in response to the survey; and(C)a summary of the comments received pursuant to the most recent opportunity to submit comments under subsection (a)(2); and(2)submit to Congress a report with recommendations to improve the regulation of data centers, including with respect to the issue of transparency.(c)CoordinationIn carrying out this section, the Assistant Secretary shall coordinate with—(1)the Administrator of the Environmental Protection Agency;(2)the Secretary of Energy; and(3)the head of any other Federal department or agency the Assistant Secretary determines appropriate.(d)DefinitionsIn this section:(1)Assistant SecretaryThe term Assistant Secretary means the Assistant Secretary of Commerce for Communications and Information.(2)Data centerThe term data center has the meaning given that term in section 453(a) of the Energy Independence and Security Act of 2007 ( 42 U.S.C. 17112(a) ).
