Section 2301-A of the act of April 9, 19291 (P.L.177, No.175), known as The Administrative Code of 1929, is2 amended by adding a paragraph to read:3 Section 2301-A. Powers and duties.4 The Department of Drug and Alcohol Programs shall have the5 power and its duty shall be:6* * *7(8.3) In accordance with the provisions of 62 Pa.C.S.8 (relating to procurement), to consult with the Department of9 General Services to utilize a competitive procurement process10 for opioid antagonists. The following shall apply:11(i) During the procurement process, the Department12of Drug and Alcohol Programs and the Department of13General Services shall consider:14(A) Cost-effectiveness, weighted at no less than1590% with regard to determining the procurement16contract.17(B) Product efficacy.18(C) Timely availability.19(D) The use of generic and name brand products.20(E) Shelf life of the product.21(ii) The Department of Drug and Alcohol Programs22shall, in consultation with the Department of General23Services, submit a report detailing the procurement24process, vendor selection and distribution strategy to25the chairperson and minority chairperson of the Health26and Human Services Committee of the Senate and the27chairperson and minority chairperson of the Human28Services Committee of the House of Representatives no29later than December 31, 2028, and each year thereafter.30(iii) As used in this paragraph, the term "opioid20260HB2731PN3815 - 2 -1antagonist" means as defined in section 13.8 of the act2of April 14, 1972 (P.L.233, No.64), known as The3Controlled Substance, Drug, Device and Cosmetic Act.4 Section 2.
