RAMOS -- read twice and ordered printed, and whenprinted to be committed to the Committee on RulesAN ACT to amend the public officers law, in relation to extendingcertain conflict of interest prohibitions to spouses, domestic orromantic partners, persons residing in the same household, or immedi-ate family members of members of the legislatureTHE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-BLY, DO ENACT AS FOLLOWS:Section 1. The public officers law is amended by adding a new section75-b to read as follows:§ 75-B. CONFLICT OF INTEREST OF A SPOUSE, DOMESTIC OR ROMANTIC PART-NER, PERSON RESIDING IN THE SAME HOUSEHOLD, OR IMMEDIATE FAMILY MEMBEROF A MEMBER OF THE LEGISLATURE. 1. FOR PURPOSES OF THIS SECTION, ANYFINANCIAL INTEREST, COMPENSATION ARRANGEMENT, CONTRACTUAL RELATIONS, OROTHER PECUNIARY BENEFIT HELD BY THE SPOUSE, DOMESTIC OR ROMANTIC PART-NER, PERSON RESIDING IN THE SAME HOUSEHOLD, OR IMMEDIATE FAMILY MEMBEROF A MEMBER OF THE LEGISLATURE SHALL BE DEEMED AN INDIRECT INTEREST OFSUCH MEMBER OF THE LEGISLATURE.2. NO SPOUSE, DOMESTIC OR ROMANTIC PARTNER, PERSON RESIDING IN THESAME HOUSEHOLD, OR IMMEDIATE FAMILY MEMBER OF A MEMBER OF THE LEGISLA-TURE SHALL KNOWINGLY SOLICIT, NEGOTIATE FOR, ACCEPT, OR ENTER INTO ANYAGREEMENT, PROMISE, UNDERSTANDING, ARRANGEMENT, CONTRACT, COMPENSATION,OR OTHER PECUNIARY BENEFIT, WHETHER SUCH COMPENSATION OR OTHER PECUNIARYINTEREST IS TO BE PAID IMMEDIATELY OR AT A FUTURE DATE, FROM ANY PERSON,FIRM, CORPORATION, LIMITED LIABILITY COMPANY, PARTNERSHIP, DEVELOPER,CONTRACTOR, OR OTHER ENTITY THAT:(A) HAS A MATTER PENDING BEFORE A STATE AGENCY, PUBLIC AUTHORITY, ORLOCAL GOVERNMENTAL ENTITY WITHIN A COUNTY IN WHICH THE LEGISLATORREPRESENTS ANY PART OF; AND(B) MAY REASONABLY BE EXPECTED TO BENEFIT FINANCIALLY FROM OFFICIALACTION, INFLUENCE, OR ADVOCACY INVOLVING SUCH LEGISLATOR.3. THE ACTIVITIES, AGREEMENTS, OR ARRANGEMENTS PROHIBITED PURSUANT TOSUBDIVISION TWO OF THIS SECTION SHALL BE DEEMED TO INCLUDE ANY PROMISE,AGREEMENT, UNDERSTANDING, OR COMMITMENT MADE WHILE THE LEGISLATOR ISEXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets[ ] is old law to be omitted.LBD16093-02-6S. 10657 2SERVING AS A MEMBER OF THE LEGISLATURE, REGARDLESS OF WHETHER SUCHCOMPENSATION OR OTHER PECUNIARY INTEREST IS PROVIDED BEFORE, WHILE, ORAFTER SUCH LEGISLATOR SERVES AS A MEMBER OF THE LEGISLATURE.4. NOTWITHSTANDING ANY OTHER PROVISION OF THE LAW, A VIOLATION OF THISSECTION SHALL BE DEEMED CURED IF THE FINANCIAL INTEREST, COMPENSATION OROTHER PECUNIARY BENEFIT IS FULLY RETURNED TO THE PAYOR OR OTHERWISEDIVESTED BY THE SPOUSE, DOMESTIC OR ROMANTIC PARTNER, PERSON RESIDING INTHE SAME HOUSEHOLD, OR IMMEDIATE FAMILY MEMBER OF A MEMBER OF THE LEGIS-LATURE WITHIN FOURTEEN DAYS AFTER THE LEGISLATOR OR SUCH SPOUSE, DOMES-TIC OR ROMANTIC PARTNER, PERSON RESIDING IN THE SAME HOUSEHOLD, OR IMME-DIATE FAMILY MEMBER KNOWS OR REASONABLY SHOULD HAVE KNOWN OF THEPROHIBITED INDIRECT INTEREST.§ 2. This act shall take effect immediately.
