AN ACT to amend the public health law, in relation to enacting the
"Public Health Modernization Act"
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. This act shall be known and may be cited as the "Public
Health Modernization Act".
§ 2. The public health law is amended by adding a new section 225-a to
read as follows:
§ 225-A. REPEAL AND REPLACEMENT OF CERTAIN SANITARY CODE SECTIONS. THE
DEPARTMENT SHALL REPEAL SUBPART 24-2 OF PART 24 OF TITLE 10 OF THE NEW
YORK CODES, RULES AND REGULATIONS IN ITS ENTIRETY AND, IN CONSULTATION
WITH PUBLIC HEALTH EXPERTS, PROMULGATE NEW RULES AND REGULATIONS GOVERN-
ING THE LICENSING AND OPERATION OF COMMERCIAL ESTABLISHMENTS REFERENCED
IN SUCH REPEALED SUBPART. SUCH NEW RULES AND REGULATIONS SHALL ESTABLISH
MINIMUM STANDARDS TO PROMOTE THE HEALTH AND SAFETY OF PATRONS AND
EMPLOYEES, CONSISTENT WITH MODERN PUBLIC HEALTH STRATEGIES FOCUSED ON
WELLNESS EDUCATION AND HARM REDUCTION.
§ 3. This act shall take effect on the one hundred eightieth day after
it shall have become a law.
