BOTTCHER -- read twice and ordered printed, and whenprinted to be committed to the Committee on RulesAN ACT to amend the public health law, in relation to enacting the"Public Health Modernization Act"THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-BLY, DO ENACT AS FOLLOWS:Section 1. This act shall be known and may be cited as the "PublicHealth Modernization Act".§ 2. The public health law is amended by adding a new section 225-a toread as follows:§ 225-A. REPEAL AND REPLACEMENT OF CERTAIN SANITARY CODE SECTIONS. THEDEPARTMENT SHALL REPEAL SUBPART 24-2 OF PART 24 OF TITLE 10 OF THE NEWYORK CODES, RULES AND REGULATIONS IN ITS ENTIRETY AND, IN CONSULTATIONWITH PUBLIC HEALTH EXPERTS, PROMULGATE NEW RULES AND REGULATIONS GOVERN-ING THE LICENSING AND OPERATION OF COMMERCIAL ESTABLISHMENTS REFERENCEDIN SUCH REPEALED SUBPART. SUCH NEW RULES AND REGULATIONS SHALL ESTABLISHMINIMUM STANDARDS TO PROMOTE THE HEALTH AND SAFETY OF PATRONS ANDEMPLOYEES, CONSISTENT WITH MODERN PUBLIC HEALTH STRATEGIES FOCUSED ONWELLNESS EDUCATION AND HARM REDUCTION.§ 3.
