AN ACT to amend the education law, in relation to humanoid robots and
artificial intelligence avatars in instructional settings
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The education law is amended by adding a new section 3039
to read as follows:
§ 3039. HUMANOID ROBOTS AND ARTIFICIAL INTELLIGENCE AVATARS IN
INSTRUCTIONAL SETTINGS; PROHIBITION. 1. FOR PURPOSES OF THIS SECTION,
THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS:
(A) "ARTIFICIAL INTELLIGENCE-ENABLED HUMANOID ROBOT" SHALL MEAN A
PHYSICAL ROBOTIC DEVICE THAT:
(I) IS DESIGNED OR MARKETED TO SIMULATE HUMAN APPEARANCE, EXPRESSION,
MOVEMENT, VOICE, OR SOCIAL INTERACTION; AND
(II) USES ARTIFICIAL INTELLIGENCE OR MACHINE LEARNING TO GENERATE
AUTONOMOUS OR INTERACTIVE RESPONSES TO USERS THROUGH SPEECH, GESTURES,
FACIAL EXPRESSIONS, OR OTHER FORMS OF COMMUNICATION.
(B) "INSTRUCTIONAL CAPACITY" SHALL MEAN THE USE OF AN ARTIFICIAL
INTELLIGENCE-ENABLED HUMANOID ROBOT TO:
(I) DELIVER, LEAD, FACILITATE, OR DIRECT CLASSROOM INSTRUCTION;
(II) PROVIDE ONE-ON-ONE OR SMALL-GROUP ACADEMIC INSTRUCTION, TUTORING,
OR EDUCATIONAL SUPPORT TO STUDENTS;
(III) ASSESS, EVALUATE, OR GRADE STUDENT WORK OR ACADEMIC PERFORMANCE;
OR
(IV) OTHERWISE PERFORM DUTIES THAT ARE ORDINARILY PERFORMED BY A
CERTIFIED TEACHER, TEACHING ASSISTANT, OR OTHER CERTIFICATED OR LICENSED
SCHOOL EMPLOYEE IN PROVIDING INSTRUCTION TO STUDENTS.
2. EACH SCHOOL DISTRICT, CHARTER SCHOOL, AND BOARD OF COOPERATIVE
EDUCATIONAL SERVICES SHALL ADOPT AND IMPLEMENT A WRITTEN POLICY GOVERN-
ING THE USE OF HUMANOID ROBOTS IN SCHOOLS.
3. THE POLICY ADOPTED AND IMPLEMENTED PURSUANT TO SUBDIVISION TWO OF
THIS SECTION SHALL PROHIBIT THE USE OF AN ARTIFICIAL INTELLIGENCE-ENA-
BLED HUMANOID ROBOT IN AN INSTRUCTIONAL CAPACITY.
§ 2. This act shall take effect on the ninetieth day after it shall
have become a law.
