HOUSE BILL NO. 6301
A bill to amend 1927 PA 175, entitled
"The code of criminal procedure,"
(MCL 760.1 to 777.69) by adding section 3a to chapter
IV.
the people of the state of michigan enact:
CHAPTER
IV
Sec. 3a. (1)
Beginning October 1, 2026, each court shall post to the court's website both of
the following:
(a) The court's failure to appear rate, fugitive rate, or both.
(b) The number of active warrants the court has, listed separately by
traffic, misdemeanor, and felony offenses.
(2) As used in this section:
(a) "Failure to appear" means the failure to appear before
court by a defendant for a hearing or any scheduled and required appearances.
(b) "Failure to appear rate" means the number of defendants
who qualify as failure to appear divided by the total population of defendants
in the court's system.
(c) "Fugitive" means an individual under judicial authority,
including, but not limited to, defendants on pretrial release, probationers, and
parolees, who fail to appear in court, abscond from supervision, or become
fugitives from justice.
(d) "Fugitive rate" means the number of individuals who
qualify as a fugitive divided by the total number of individuals under judicial
authority.
