HOUSE BILL NO. 6280
A bill to amend 1953 PA 232, entitled
"Corrections code of 1953,"
(MCL 791.201 to 791.285) by adding section 67d.
the people of the state of michigan enact:
Sec. 67d. (1) The
department shall maintain policies on the use of a recording device in a
sensitive medical setting. The policy shall ensure all of the following:
(a) That the use of a recording device in a sensitive medical setting is
limited to circumstances in which it is reasonably necessary for safety,
security, or documentation purposes.
(b) That if a recording device is used, the recording device is used in
a manner that minimizes intrusion on the privacy of the prisoner to the
greatest extent practicable and the reason for using the recording device is
documented.
(2) The department shall maintain a policy on the retention, storage,
and access to a recording created in a sensitive medical setting through a
recording device, in a manner that complies with any applicable law.
(3) As used in this section:
(a) "Medical care" includes a physical, mental, optical, and dental
health service.
(b) "Recording device" means a device, other than a device
used to provide medical care through telehealth, that is capable of capturing
audio, video, or photographic images of a prisoner.
(c) "Sensitive medical setting" means a setting where medical
care is provided to a prisoner under circumstances where the prisoner has an
expectation of privacy.
