hb6280/introduced.txtHOUSE BILL NO. 6280A bill to amend 1953 PA 232, entitled"Corrections code of 1953,"(MCL 791.201 to 791.285) by adding section 67d.the people of the state of michigan enact:Sec. 67d. (1) Thedepartment shall maintain policies on the use of a recording device in asensitive medical setting. The policy shall ensure all of the following:(a) That the use of a recording device in a sensitive medical setting islimited to circumstances in which it is reasonably necessary for safety,security, or documentation purposes.(b) That if a recording device is used, the recording device is used ina manner that minimizes intrusion on the privacy of the prisoner to thegreatest extent practicable and the reason for using the recording device isdocumented.(2) The department shall maintain a policy on the retention, storage,and access to a recording created in a sensitive medical setting through arecording device, in a manner that complies with any applicable law.(3) As used in this section:(a) "Medical care" includes a physical, mental, optical, and dentalhealth service.(b) "Recording device" means a device, other than a deviceused to provide medical care through telehealth, that is capable of capturingaudio, video, or photographic images of a prisoner.(c) "Sensitive medical setting" means a setting where medicalcare is provided to a prisoner under circumstances where the prisoner has anexpectation of privacy.
