Provides that two-thirds of each house shall constitute a quorum to do business, but a smaller number may adjourn from day to day, and compel the attendance of absent members, in such manner and under such penalties as each house may provide (now, a majority of the members elected to each house constitutes a quorum). Effective upon being declared adopted in accordance with Section 7 of the Illinois Constitutional Amendment Act.LRB104 14626 JDS 27768 eHC0019 LRB104 14626 JDS 27768 e1 HOUSE JOINT RESOLUTION2 CONSTITUTIONAL AMENDMENT3 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE4 HUNDRED FOURTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE5 SENATE CONCURRING HEREIN, that there shall be submitted to the6 electors of the State for adoption or rejection at the general7 election next occurring at least 6 months after the adoption8 of this resolution a proposition to amend Section 6 of Article9 I of the Illinois Constitution as follows:10 ARTICLE IV11 THE LEGISLATURE12 (ILCON Art. IV, Sec. 6)13 SECTION 6. ORGANIZATION14 (a) Two-thirds of each house shall constitute [A majority ]15 [of the members elected to each house constitutes] a quorum to do16 business, but a smaller number may adjourn from day to day, and17 compel the attendance of absent members, in such manner and18 under such penalties as each house may provide.19 (b) On the first day of the January session of the General20 Assembly in odd-numbered years, the Secretary of State shall21 convene the House of Representatives to elect from its22 membership a Speaker of the House of Representatives as23 presiding officer, and the Governor shall convene the SenateHC0019 - 2 - LRB104 14626 JDS 27768 e1 to elect from its membership a President of the Senate as2 presiding officer.3 (c) For purposes of powers of appointment conferred by4 this Constitution, the Minority Leader of either house is a5 member of the numerically strongest political party other than6 the party to which the Speaker or the President belongs, as the7 case may be.8 (d) Each house shall determine the rules of its9 proceedings, judge the elections, returns and qualifications10 of its members and choose its officers. No member shall be11 expelled by either house, except by a vote of two-thirds of the12 members elected to that house. A member may be expelled only13 once for the same offense. Each house may punish by14 imprisonment any person, not a member, guilty of disrespect to15 the house by disorderly or contemptuous behavior in its16 presence. Imprisonment shall not extend beyond twenty-four17 hours at one time unless the person persists in disorderly or18 contemptuous behavior.19 (Source: Illinois Constitution.)20 SCHEDULE21 This Constitutional Amendment takes effect upon being22 declared adopted in accordance with Section 7 of the Illinois23 Constitutional Amendment Act.
