sb248/enrolled.txtAn ActENROLLED SENATEBILL NO. 248 By: Logan of the SenateandHill and Provenzano of theHouseAn Act relating to tourism; amending 74 O.S. 2021,Section 2251, which relates to the Oklahoma Tourismand Recreation Department Revolving Fund; amendingproperties of the fund; declaring funds appropriated;determining interest stays within the fund; creatingthe Real Property Proceeds Revolving Fund;establishing revolving fund characteristics;declaring funds appropriated; determining intereststays within the fund; providing for codification;and providing an effective date.SUBJECT: Oklahoma Tourism and Recreation DepartmentBE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:SECTION 1. AMENDATORY 74 O.S. 2021, Section 2251, isamended to read as follows:Section 2251. A. There is hereby created in the State Treasurya revolving fund for the Oklahoma Tourism and Recreation Departmentto be designated the “Oklahoma Tourism and Recreation DepartmentRevolving Fund”. The fund shall be a continuing fund, not subjectto fiscal year limitations, and shall consist of all monies receivedby the Department pursuant to the provisions of this act, moniesderived from the sale or conveyance of real property under thejurisdiction of the Commission, and interest attributable toinvestment of money in the fund. The revolving fund shall be acontinuing fund not subject to fiscal year limitations and shall beunder the administrative direction of the Department. Expendituresfrom the fund created by this section shall be for theadministration, operation, and maintenance expenses of theDepartment, for purchase of real property, and shall be madepursuant to the laws of this state and the statutes relating to theDepartment. Expenditures from said fund shall be made upon warrantsissued by the State Treasurer against claims filed as prescribed bylaw with the Director of the Office of Management and EnterpriseServices for approval and payment the Oklahoma Tourism, Parks andRecreation Enhancement Act. All monies accruing to the credit ofthe fund are hereby appropriated and may be budgeted and expended bythe Department for the administration, operation, and maintenanceexpenses of the Department, for purchase of real property, and shallbe made pursuant to the laws of this state. Expenditures from thefund shall be made upon warrants issued by the State Treasureragainst claims filed as prescribed by law with the Director of theOffice of Management and Enterprise Services for approval andpayment.B. Notwithstanding any provision of law, all interest andincome derived from deposits to the Oklahoma Tourism and RecreationDepartment Revolving Fund shall be credited to the Oklahoma Tourismand Recreation Department Revolving Fund.SECTION 2. NEW LAW A new section of law to be codifiedin the Oklahoma Statutes as Section 2251.1 of Title 74, unless thereis created a duplication in numbering, reads as follows:A. There is hereby created in the State Treasury a revolvingfund for the Oklahoma Tourism and Recreation Department to bedesignated the “Real Property Proceeds Revolving Fund”. The fundshall be a continuing fund, not subject to fiscal year limitations,and shall consist of all monies derived from the sale, transfer,lease, or other conveyance of real property under the jurisdictionof the Oklahoma Tourism and Recreation Commission, except thoseleases entered into pursuant to a concessionaire agreement. Allmonies accruing to the fund are hereby appropriated and may beexpended by the Department for maintenance and capital projectsincluded on the annually updated five-year plan approved by theLong-Range Capital Planning Commission pursuant to Section 188A ofTitle 73 of the Oklahoma Statutes; provided, such monies shall notbe expended for compensation of any employee of a state agency. Nomonies from the fund shall be transferred for any purpose to anyother state agency. Expenditures from the fund shall be made uponENR. S. B. NO. 248 Page 2warrants issued by the State Treasurer against claims filed asprescribed by law with the Director of the Office of Management andEnterprise Services for approval and payment.B. Notwithstanding any provision of law, all interest andincome derived from deposits to the Real Property Proceeds RevolvingFund shall be credited to the Real Property Proceeds Revolving Fund.SECTION 3.
