No. 1288 Page 1112 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:23 SECTION 1. NEW LAW A new section of law not to be34 codified in the Oklahoma Statutes reads as follows:45 The Legislature finds and declares the following:56 1. Strengthening public education is a cornerstone of democracy67 and must be supported, improved, and made more efficient to serve78 all students effectively. The Fund Students, Not Systems Act89 created in Section 2 of this act is designed to provide families910 with options while incentivizing innovation and excellence within1011 public schools in this state;1112 2. This state’s education system must prioritize meeting the1213 diverse needs of every student, whether the student thrives in a1314 traditional public school, charter school, or alternative1415 educational setting. Providing families with additional options1516 will help ensure that no child is left behind or underserved;1617 3. Taxpayers in this state invest heavily in education, and the1718 provisions of this act ensure that funding is allocated fairly to1819 benefit the students it is intended to serve. Public schools shall1920 continue to receive robust funding, and families shall have the2021 flexibility to choose the best educational setting for their2122 children;2223 4. Teachers and administrators are the backbone of the2324 education system in this state. The provisions of this act support24Req. No. 1288 Page 21 their mission by reducing overcrowding, allowing them to focus on12 students who thrive in public school environments, and providing23 opportunities for public schools to innovate and compete;345. By encouraging parental choice and educational flexibility,45 the provisions of this act provide opportunities for public schools56 to highlight their strengths, develop new programs, and attract67 families seeking high-quality education;786. The ultimate goal of the provisions of this act is to89 improve student outcomes across all educational settings. By910 focusing resources on the individual needs of students, this state1011 shall foster a culture of academic excellence and lifelong success;1112 and12137. A more dynamic and competitive educational landscape will1314 encourage the development of cutting-edge programs and teaching1415 methods that benefit public school teachers and administrators.1516SECTION 2. NEW LAW A new section of law to be codified1617 in the Oklahoma Statutes as Section 28-200 of Title 70, unless there1718 is created a duplication in numbering, reads as follows:1819A. This act shall be known and may be cited as the “Fund1920 Students, Not Systems Act”.2021B. As used in this act:21221. “Compulsory attendance compliance” means adherence to the2223 provisions of Section 10-105 of Title 70 of the Oklahoma Statutes,2324 ensuring that all students meet attendance requirements through24Req. No. 1288 Page 31 public, private, or charter school, or the other means of education12 exception provided for in subsection A of Section 10-105 of Title 7023 of the Oklahoma Statutes;34 2. “Department” means the State Department of Education;45 3. “Education savings account” or “ESA” means an account56 established to receive state education funds for the benefit of an67 eligible student;78 4. “Eligible student” means a resident of this state who is89 eligible to enroll in a public school in this state and is over the910 age of five (5) and under the age of eighteen (18). Eligible1011 student includes students who have not reached the age of twenty-two1112 (22) if they are subject to the provisions of the Individuals with1213 Disabilities Education Act (IDEA);1314 5. “Participating educational provider” means any public,1415 private, charter, or virtual charter school chosen by the parent or1516 legal guardian or the other means of education exception provided1617 for in subsection A of Section 10-105 of Title 70 of the Oklahoma1718 Statutes;1819 6. “Program” means the Fund Students, Not Systems Education1920 Savings Account Program; and2021 7. “Qualified expense” means the following services provided by2122 a participating educational provider:2223a. tuition and/or fees for curriculum and instruction,2324b. instructional materials, textbooks, and supplies,24Req. No. 1288 Page 41c. tutoring or educationally necessary occupational,12physical, or speech therapy,23d. fees for nationally standardized assessments34including, but not limited to, assessments used to45determine college admission and advanced placement56examinations,67e. fees for transportation related to travel to and from78a participating educational service provider, up to89One Thousand Dollars ($1,000.00) per school year,910f. tuition for a curriculum or program offered by a1011technology center school,1112g. fees associated with participation in extracurricular1213activities, and1314h. admission fees for state parks, museums, and other1415educational field trips.1516 C. There is hereby created the Fund Students, Not Systems1617 Education Savings Account Program to be administered by the State1718 Department of Education to provide an education savings account1819 (ESA) for qualified expenses to support the education of an eligible1920 student in this state.2021 D. 1. To apply for an ESA, the parent or legal guardian of an2122 eligible student shall submit an application to the State Department2223 of Education on a form prescribed by the Department and published on2324 its website. The form shall include, at a minimum, the eligible24Req. No. 1288 Page 51 student’s name, the name of the eligible student’s parent or legal12 guardian, proof of the eligible student’s residency in this state,23 and an attestation that the ESA will only be used for qualified34 expenses. The application shall be submitted online or by mail by45 April 1 preceding the school year for which an ESA is sought.56 2. The State Board of Education shall establish procedures and67 timelines to approve applications submitted pursuant to paragraph 178 of this subsection.89 3. ESA renewal applications shall include confirmation of910 continued eligibility and an attestation that the ESA will only be1011 used for qualified expenses.1112 E. 1. For each eligible student approved to participate in the1213 program, the State Department of Education shall calculate an amount1314 equivalent to the total State Aid factors for the applicable school1415 year multiplied by the grade and disability weights for which the1516 student is eligible for the applicable school year. The Department1617 on a quarterly basis shall transfer the amount calculated pursuant1718 to this paragraph into an ESA in the name of the eligible student.1819 Funds deposited into an ESA but unused shall accrue from quarter to1920 quarter and from year to year unless the ESA is closed or the2021 student is no longer eligible to participate in the program.2122 2. The State Department of Education shall calculate the total2223 costs of all ESAs for all eligible students in this state and shall2324 reserve or retain from the total amount appropriated to the State24Req. No. 1288 Page 61 Board of Education for State Aid purposes and any other revenue12 available for allocation for State Aid purposes the total cost for23 all ESAs.34 F. 1. Nothing in this act shall limit the independence or45 autonomy of private schools or homeschool families who provide56 another means of education pursuant to the exception provided for in67 subsection A of Section 10-105 of Title 70 of the Oklahoma Statutes.78 2. Nothing in this act shall require private schools or89 homeschool families who provide another means of education pursuant910 to the exception provided for in subsection A of Section 10-105 of1011 Title 70 of the Oklahoma Statutes to:1112a. adhere to subject matter standards provided for in1213Section 11-103.6 of Title 70 of the Oklahoma Statutes,1314b. obtain accreditation from the State Board of Education1415or another accrediting association,1516c. employ teachers who are certified pursuant to Sections16176-190 or 6-122.3 of Title 70 of the Oklahoma Statutes,1718or1819d. be subject to auditing or financial reporting1920requirements of the State Board of Education.2021 G. By December 31, 2026, and each December 31 thereafter, the2122 State Department of Education shall electronically submit a report2223 on the program to the Governor, the President Pro Tempore of the2324 Senate, and the Speaker of the House of Representatives. The report24Req. No. 1288 Page 71 shall include the total amount of funds allocated to ESAs for the12 prior school year and the average amount allocated per ESA. The23 Legislature may use the report to make adjustments to the amount of34 funds allocated for the financial support of public schools for the45 ensuing fiscal year.56 H. 1. The State Board of Education shall promulgate rules to67 implement the provisions of this act.78 2. No administrative rule promulgated by the Board or action of89 the Board shall impose additional requirements, oversight, or910 regulations on private schools or homeschool families who provide1011 another means of education pursuant to the exception provided for in1112 subsection A of Section 10-105 of Title 70 of the Oklahoma Statutes1213 beyond those explicitly stated in this act.1314 SECTION 3. NEW LAW A new section of law to be codified1415 in the Oklahoma Statutes as Section 28-201 of Title 70, unless there1516 is created a duplication in numbering, reads as follows:1617 The provisions of the Fund Students, Not Systems Act created1718 pursuant to Section 2 of this act are severable and if any part or1819 provision shall be held void, the decision of the court so holding1920 shall not affect or impair any of the remaining parts or provisions2021 of the Fund Students, Not Systems Act.2122 SECTION 4. This act shall become effective July 1, 2025.2223 SECTION 5. It being immediately necessary for the preservation2324 of the public peace, health, or safety, an emergency is hereby24Req.
