1     AN ACT Relating to improving access to abortion       medications;
2 amending RCW 72.09.780; and declaring an emergency.
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
4     Sec. 1. RCW 72.09.780 and 2025 c 424 s 1912 are each amended to
5 read as follows:
6     (1) The department is authorized to acquire, receive, possess,
7 sell, resell, deliver, dispense, distribute, and engage in any
8 activity   constituting  the   practice  of   pharmacy  or  wholesale
9 distribution with respect to abortion medications.
10     (2) The department may exercise the authority granted in this
11 section for the benefit of any person, whether or not the person is
12 in the custody or under the supervision of the department.
13     (3) The department shall exercise the authority granted in this
14 section in accordance with any applicable law including, but not
15 limited to, any applicable licensing requirements, except that the
16 department is exempt from obtaining a wholesaler's license for any
17 actions taken pursuant to chapter 195, Laws of 2023 as provided in
18 RCW 18.64.046.
19     (4)(((a))) The department shall establish and operate a program
20 to deliver, dispense, and distribute abortion medications described
21 in this section. In circumstances in which the department is selling,

1 delivering, or distributing abortion medications to a health care
2 provider or health care entity, it may only sell, distribute, or
3 deliver abortion medications to health care providers and health care
4 entities that will only use the medications for the purposes of
5 providing reproductive health care including abortion care or medical
6 management of early pregnancy loss. The department shall coordinate
7 with the department of health to identify appropriate recipients of
8 the abortion medications and prioritize bulk distribution to health
9 care providers and health care entities, including Indian health care
10 providers. The department may but is not required to obtain any
11 payment   for  delivering,   dispensing,   or  distributing   abortion
12 medications or engaging in any other activity under this section.
13     (((b) Except as provided in (c) of this subsection, any abortion
14 medications sold, resold, delivered, dispensed, or distributed
15 whether individually or wholesale shall be conducted at cost not to
16 exceed list price, plus a fee of $5 per dose to offset the cost of
17 secure storage and delivery of medication. Revenues generated
18 pursuant to chapter 195, Laws of 2023 shall be deposited to the
19 general fund.
20     (c) During the 2025 fiscal year, any abortion medications sold,
21 resold, delivered, dispensed, or distributed whether individually or
22 wholesale shall be conducted at cost not to exceed list price.))
23     (5) Nothing in this section shall diminish any existing authority
24 of the department.
25     (6) For the purposes of this section, the following definitions
26 apply:
27     (a) "Abortion medications" means substances used in the course of
28 medical treatment intended to induce the termination of a pregnancy
29 or manage the full spectrum of reproductive health care including,
30 but not limited to, mifepristone and misoprostol.
31     (b) "Deliver" has the same meaning as in RCW 18.64.011.
32     (c) "Dispense" has the same meaning as in RCW 18.64.011.
33     (d) "Distribute" has the same meaning as in RCW 18.64.011.
34     (e) "Health care entity" means a hospital, clinic, Indian health
35 care provider, urban Indian health organization, pharmacy, office, or
36 similar setting where a health care provider provides health care to
37 patients.
38     (f) "Health care provider" has the same meaning as in RCW
39 70.02.010.
40     (g) "Person" has the same meaning as in RCW 18.64.011.

1     (h) "Practice of pharmacy" has the same meaning as in        RCW
2 18.64.011.
3     (i) "Wholesale distribution" has the same meaning as in      WAC
4 246-945-001.
5     NEW SECTION.   Sec. 2.  This act is necessary for the immediate
6 preservation of the public peace, health, or safety, or support of
7 the state government and its existing public institutions, and takes
8 effect immediately.
