3  LONG TITLE
4  General Description:
5      This rules resolution modifies the duties of a House standing committee.
6  Highlighted Provisions:
7      This resolution:
8      ▸ defines terms;
9      ▸ when considering legislation that proposes to make an occupation a regulated occupation,
10  requires a House standing committee to determine whether the Office of Professional
11  Licensure Review conducted a sunrise review of the occupation; and
12      ▸ makes technical and conforming changes.

21  Be it resolved by the House of Representatives of the state of Utah:
22Section 1. HR3-2-402 is amended to read:
23HR3-2-402 . Standing committee consideration of legislation -- Regulated
24  occupation -- Fiscal impact.
25  (1) As used in this rule:
26      (a) "Office" means the Office of Professional Licensure Review created in Utah Code
27Title 13, Chapter 1b, Office of Professional Licensure Review.
28      (b) "Regulated occupation" means the same as that term is defined in Utah Code Section
2913-1b-101.

30   (2) When considering legislation that proposes to make an occupation a regulated
31occupation, a standing committee shall determine whether the office conducted a sunrise
32review of the occupation in accordance with Utah Code Title 13, Chapter 1b, Part 3,
33Office Review and Reporting.
34   (3)(a)[(a)] (i) A standing committee may not [review] consider legislation unless the
35legislation has an approved fiscal note.
36[(b)] (ii) Notwithstanding Subsection [(1)(a)] (3)(a)(i), a standing committee may
37consider a substitute not previously adopted, regardless of whether the substitute
38has an approved fiscal note.
39[(2)] (b) Except as provided in HR3-2-401, a standing committee in one or both
40chambers shall [review] consider legislation before the legislation is held in the
41opposite chamber because of the legislation's fiscal impact.
42Section 2. Effective Date.
43   This resolution takes effect upon a successful vote for final passage.
