8 Statement of purpose of bill as introduced: This bill proposes to exempt
9 municipalities from the Act 250 requirement to mitigate reduction of primary
10 agricultural soils.
11    An act relating to exempting municipalities from the Act 250 requirement to
12    mitigate reduction of primary agricultural soils
13 It is hereby enacted by the General Assembly of the State of Vermont:
14 Sec. 1. 10 V.S.A. § 6093 is amended to read:
15 § 6093. MITIGATION OF PRIMARY AGRICULTURAL SOILS

17    (c) Municipal use exemption. Notwithstanding any other provision of this
18 section to the contrary, the requirements for mitigation of primary agricultural
19 soils shall not apply to the conversion or development of such soils when the
20 development is undertaken by a municipality on land owned by the

1 municipality and the municipality demonstrates that there are no reasonable
2 alternative locations within its jurisdiction that would avoid or minimize the
3 impact to primary agricultural soils and the proposed use of the development
4 is:
5(1) exclusively for municipal purposes, including the construction,
6 expansion, or operation of municipal infrastructure, public safety facilities, or
7 public works; or
8(2) intended solely for the recreation, health, or welfare of the residents
9 of that municipality and is open for general public use.
10 Sec. 2. EFFECTIVE DATE
11This act shall take effect on July 1, 2026.
