5Relating to the Alabama Sunset Law; to continue the
6 existence and functioning of the Alabama Sickle Cell Oversight
7 and Regulatory Commission until October 1, 2030, with certain
8 modifications; to amend Sections 22-10B-1 and 22-10B-2, Code
9 of Alabama 1975, to place the commission as a division within
10 the Alabama Department of Public Health; to require the
11 department to provide all necessary administrative services
12 for the commission; to authorize the department to provide for
13 an executive director and outside experts for the commission;
14 to transfer all property of the commission to the department;
15 to change board members from being appointed subject to
16 confirmation by the Senate to serving upon appointment unless
17 and until rejected by the Senate; and to repeal Section
18 22-10B-7, Code of Alabama 1975, relating to the Alabama Sickle
19 Cell Oversight and Regulatory Commission.
20 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
21Section 1. Pursuant to the Alabama Sunset Law, the
22 Sunset Committee recommends the continuance of the Alabama
23 Sickle Cell Oversight and Regulatory Commission until October
24 1, 2030, with additional recommendation for statutory change
25 as set out in Sections 3 and 4.
26Section 2. The existence and functioning of the Alabama
27 Sickle Cell Oversight and Regulatory Commission, created and
28 functioning pursuant to Sections 22-10B-1 to 22-10B-7,

29 inclusive, Code of Alabama 1975, is continued until October 1,
30 2030, and those code sections are expressly preserved.
31Section 3. Section 22-10B-1 and 22-10B-2, Code of
32 Alabama 1975, are amended to read as follows:
33"§22-10B-1
34(a) There is created and, beginning on October 1, 2026,
35 established as a division within the Alabama Department of
36 Public Health, the Alabama Sickle Cell Oversight and
37 Regulatory Commission.
38(b) The department shall provide to the commission all
39 administrative services necessary for the commission to carry
40 out its duties, including:
41(1) Financial services;
42(2) Legal services;
43(3) Dedicated office space;
44(4) Administrative staff, who are shared with or
45 dedicated solely to the commission, and other personnel as
46 necessary for the efficient operation of the commission;
47(5) Information technology services, including website
48 maintenance and dedicated phone lines and email addresses for
49 commission members and staff; and
50(6) Necessary office furniture and supplies.
51(c)(1) Any contract or binding agreement for
52 administrative services executed by the commission before the
53 effective date of this act shall continue in effect until
54 expiration or termination as provided by its terms. After
55 expiration or termination, the department shall assume all
56 administrative services provided by subsection (b).

57(2) The commission may enter into a contract or other
58 agreement for the provision of administrative services so long
59 as the agreement terminates on or before October 1, 2026.
60(d) When necessary, the department may retain the
61 services of outside experts, including an executive director,
62 accountants, attorneys, and consultants using funds
63 appropriated for use by the commission on behalf of the
64 commission.
65(e) On October 1, 2026, all real and personal property
66 and all other effects of the commission shall transfer to the
67 department."
68"§22-10B-2
69(a) The commission shall consist of the following
70 members:
71(1) Two members shall be appointed by the Governor.
72(2) One member shall be appointed by the University of
73 South Alabama Comprehensive Sickle Cell Center.
74(3) One member shall be appointed by the University of
75 Alabama-Birmingham Alabama at Birmingham.
76(4) One member shall be appointed by the Children's
77 Hospital of Birmingham Alabama.
78(5) Each of the seven chapters of the Sickle Cell
79 Disease Association of America-Alabama Chapter, Incorporated,
80 shall appoint one member.
81(b)(1) Appointees to the commission shall be citizens
82 residents of this state and shall be subject to confirmation
83 by the Senate, and upon confirmation, serve for a term of four
84 years. The membership of the commission shall be inclusive and

85 reflect the racial, gender, geographic, urban/rural urban,
86 rural, and economic diversity of the state. The commission
87 shall annually report to the Legislature by the second
88 legislative day of each regular session the extent to which
89 the commission has complied with the diversity provisions of
90 this subsection subdivision. In the event of the death or
91 resignation of any member of the commission, a successor shall
92 be appointed by the original appointing authority and the
93 successor appointed to the vacancy shall serve for the
94 remainder of the unexpired term. The members shall elect from
95 their membership a chair and a vice chair at an organizational
96 meeting held no later than 30 days after appointments to the
97 commission are confirmed.
98(2) All appointees shall serve their appointed terms
99 unless the Senate elects to consider and then rejects an
100 appointment. The entire Senate or the Senate Committee on
101 Confirmations may elect to consider an appointment. If an
102 appointment is rejected by the Senate Committee on
103 Confirmations, the rejection shall be considered a rejection
104 by the entire Senate.
105(c) Members of the commission shall receive no salaries
106 but may be reimbursed for actual and necessary expenditures
107 incurred in the performance of their official duties pursuant
108 to Article 2 of Chapter 7 of Title 36. Expenses of the
109 commission are to be paid from funds available to the
110 commission.
111(d) A member who has failed to attend three consecutive
112 properly noticed meetings may be removed at the request of the

113 commission."
114Section 4. Section 22-10B-7, Code of Alabama 1975,
115 relating to the Alabama Sickle Cell Oversight and Regulatory
116 Commission, is repealed.
117Section 5. The Legislature concurs in the
118 recommendations of the Sunset Committee as provided in
119 Sections 1, 2, 3, and 4.
120Section 6. This act shall become effective immediately.
