hb5482/engrossed.txtsubstitute forHouse BILL NO. 5482A bill to amend 1984 PA 431, entitled"The management and budget act,"by amending section 242 (MCL 18.1242), as amended by2012 PA 430.the peoplE of the state of michigan enact:Sec. 242. (1) State agencies, community colleges, anduniversities shall develop 5-year capital outlay plans, which shall must identifycapital outlay needs, including new construction, or the addition, renovation,adaptive reuse, and improvement of existing facilities. For state agencies,community colleges, and universities, the 5-year capital outlay plans shall must alsoinclude the need for special maintenance. These plans shall must besubmitted in electronic format to the department, to members of the JCOS, andto the fiscal agencies not later than November 1 of each year.(2) The departmentand the JCOS shall review state agency, community college, and universitycapital outlay plans. The department and the JCOS shall prioritize requests.The department shall include the department-recommended requests in theexecutive budget recommendation. If a state agency, community college, oruniversity subsequently modifies a request, the revision shall must besubmitted to the department, members of the JCOS, and the fiscal agencies.(3) The departmentand the chairperson and vice-chairperson of the JCOS shall review and evaluateby March 1 of each year capital outlay project requests received from communitycolleges, universities, and state agencies. All of the following shall must beconsidered when reviewing and evaluating project requests:(a) Investment inexisting facilities and infrastructure.(b) Life and safetydeficiencies.(c) Occupancy andutilization of existing facilities.(d) Integration ofsustainable design to enhance the efficiency and operations of the facility.(e) Estimated cost.(f) Institutionalsupport.(g) Estimatedoperating costs.(h) Impact ontuition, if any.(i) Impact on jobcreation in this state.(j) History ofprior appropriations received by the institution through the capital outlayprocess.(4) The request forprogram development and schematic planning must be approved by the JCOS and thelegislature through the appropriation process.(5) Programstatements and schematic planning documents shall must be reviewed by the department and, when thereview is completed, shall must be submitted to the JCOS as either approved ornot approved.(6) Upon review andapproval by the JCOS, the JCOS and the legislature may authorize the projectfor final design and construction with a line-item appropriation in anappropriation bill. The appropriations bill shallinclude appropriations for projected state building authority rental paymentsassociated with the projects that are authorized for construction. Theauthorization shall must include the legislative lease approval requiredfor state building authority financing.(7) Preliminaryplans shall must besubmitted to the department for review and approval. The department shallreview and approve final plans to be prepared for bidding. A summary of bidresults shall must besubmitted to the JCOS.(8) The departmentshall provide for review and oversight of capital outlay projects financedeither in total or in part by the state building authority pursuant to the provisions of in accordance with sections 237 and 237a.(9) Appropriationsmade for studies and initial plans shall are not be considereda commitment on the part of the legislature to appropriate funds for thecompletion of plans or construction of any project based on the studies orplanning documents.
