2  RELATING TO SCHOOL SAFETY; REQUIRING AUTOMATED EXTERNAL
3  DEFIBRILLATORS TO BE AVAILABLE DURING ALL SCHOOL ATHLETIC
4  ACTIVITIES.

6  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
7SECTION 1.    Section 22-33-6 NMSA 1978 (being Laws 2025,
8  Chapter 129, Section 3) is amended to read:
9"22-33-6.    CARDIAC EMERGENCY RESPONSE PLAN--AUTOMATED
10 EXTERNAL DEFIBRILLATOR.--
11A.     Each school shall develop and implement a
12 cardiac emergency response plan that addresses the
13 appropriate use of school personnel who are to respond to
14 incidents involving a person experiencing a sudden cardiac
15 arrest or a similar life-threatening emergency while on
16 school grounds or during a school athletic activity.    Each
17 cardiac emergency response plan shall:
18(1)   be developed and implemented using core
19 elements that are nationally recognized and evidence-based;
20(2)   identify specific school personnel who
21 will take action when a person experiences a sudden cardiac
22 arrest or a similar life-threatening emergency;
23(3)   establish protocols for school personnel
24 identified by the cardiac emergency response plan to follow
25 when a person experiences a sudden cardiac arrest or a  HB 256

1  similar life-threatening emergency;
2(4)   determine appropriate locations for
3  automated external defibrillators to be installed or made
4  available;
5(5)   provide for routine maintenance of the
6  automated external defibrillator; and
7(6)   be updated when necessary to be
8  consistent with evidence-based guidelines.
9B.   Every school in the state shall install an
10 automated external defibrillator.     Installed automated
11 external defibrillators shall be maintained and tested
12 according to the manufacturer's operational guidelines.
13C.   An automated external defibrillator shall be
14 clearly marked and easily accessible during each school
15 athletic activity.
16D.   The department shall adopt and promulgate rules
17 for the training of school employees on the use of automated
18 external defibrillators in a manner consistent with standards
19 adopted by the American heart association.
20E.   The requirements of Subsections A and B of this
21 section shall be fulfilled by all:
22(1)   public non-charter high schools no later
23 than the 2026-2027 school year; and
24(2)   elementary schools, middle schools,
25 charter schools and private schools no later than the 2027-  HB 256

1  2028 school year.
2F.   As used in this section, "school athletic
3  activity" means a sport or activity organized by a school or
4  school district that involves a physical game or competition
5  against another team, club or entity or practice or
6  preparation for the physical game or competition."  HB 256
