hb256/enrolled.txt1AN ACT2 RELATING TO SCHOOL SAFETY; REQUIRING AUTOMATED EXTERNAL3 DEFIBRILLATORS TO BE AVAILABLE DURING ALL SCHOOL ATHLETIC4 ACTIVITIES.56 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:7SECTION 1. Section 22-33-6 NMSA 1978 (being Laws 2025,8 Chapter 129, Section 3) is amended to read:9"22-33-6. CARDIAC EMERGENCY RESPONSE PLAN--AUTOMATED10 EXTERNAL DEFIBRILLATOR.--11A. Each school shall develop and implement a12 cardiac emergency response plan that addresses the13 appropriate use of school personnel who are to respond to14 incidents involving a person experiencing a sudden cardiac15 arrest or a similar life-threatening emergency while on16 school grounds or during a school athletic activity. Each17 cardiac emergency response plan shall:18(1) be developed and implemented using core19 elements that are nationally recognized and evidence-based;20(2) identify specific school personnel who21 will take action when a person experiences a sudden cardiac22 arrest or a similar life-threatening emergency;23(3) establish protocols for school personnel24 identified by the cardiac emergency response plan to follow25 when a person experiences a sudden cardiac arrest or a HB 256Page 11 similar life-threatening emergency;2(4) determine appropriate locations for3 automated external defibrillators to be installed or made4 available;5(5) provide for routine maintenance of the6 automated external defibrillator; and7(6) be updated when necessary to be8 consistent with evidence-based guidelines.9B. Every school in the state shall install an10 automated external defibrillator. Installed automated11 external defibrillators shall be maintained and tested12 according to the manufacturer's operational guidelines.13C. An automated external defibrillator shall be14 clearly marked and easily accessible during each school15 athletic activity.16D. The department shall adopt and promulgate rules17 for the training of school employees on the use of automated18 external defibrillators in a manner consistent with standards19 adopted by the American heart association.20E. The requirements of Subsections A and B of this21 section shall be fulfilled by all:22(1) public non-charter high schools no later23 than the 2026-2027 school year; and24(2) elementary schools, middle schools,25 charter schools and private schools no later than the 2027- HB 256Page 21 2028 school year.2F. As used in this section, "school athletic3 activity" means a sport or activity organized by a school or4 school district that involves a physical game or competition5 against another team, club or entity or practice or6 preparation for the physical game or competition."
