hb270/enrolled.txt1AN ACT2 RELATING TO PUBLIC WORKS; REQUIRING CONTRIBUTIONS TO3 APPRENTICE AND TRAINING PROGRAMS OR TO THE PUBLIC WORKS4 APPRENTICE AND TRAINING FUND FOR PUBLIC WORKS CONSTRUCTION5 PROJECTS; PROVIDING FOR A CONTRIBUTION RATE OF ZERO FOR6 NON-APPRENTICESHIP TRADE CLASSIFICATIONS FOR CERTAIN7 PROJECTS.89 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:10 SECTION 1. Section 13-4D-4 NMSA 1978 (being Laws 1992,11 Chapter 74, Section 4, as amended) is amended to read:12 "13-4D-4. ADMINISTRATION.--13A. The Public Works Apprentice and Training Act14 shall be administered by the workforce solutions department.15 The department shall collect employers' contributions in16 accordance with that act, review employers' compliance17 statements, review certified payroll reports to verify18 training contributions, investigate allegations of and impose19 penalties for employer noncompliance and disburse funds as20 provided in Section 13-4D-5 NMSA 1978.21B. Public works construction projects shall not be22 constructed unless an employer agrees to make contributions23 to approved apprentice and training programs in New Mexico in24 which the employer is a participant or to the public works25 apprentice and training fund administered by the workforce HB 270Page 11 solutions department. Contributions shall be made in the2 same manner and in the same amount as apprentice and training3 contributions required pursuant to wage rate determinations4 made by the department.5C. In establishing apprentice and training6 contributions in wage rate determinations for street,7 highway, bridge, road, utility and light engineering public8 works construction projects, the workforce solutions9 department shall set a contribution of zero for any trade10 classification for which there is no approved apprentice and11 training program.12D. The workforce solutions department shall adopt13 rules and regulations necessary to implement the provisions14 of the Public Works Apprentice and Training Act."15 SECTION 2.
