2  RELATING TO PUBLIC WORKS; REQUIRING CONTRIBUTIONS TO
3  APPRENTICE AND TRAINING PROGRAMS OR TO THE PUBLIC WORKS
4  APPRENTICE AND TRAINING FUND FOR PUBLIC WORKS CONSTRUCTION
5  PROJECTS; PROVIDING FOR A CONTRIBUTION RATE OF ZERO FOR
6  NON-APPRENTICESHIP TRADE CLASSIFICATIONS FOR CERTAIN
7  PROJECTS.

9  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
10      SECTION 1.    Section 13-4D-4 NMSA 1978 (being Laws 1992,
11 Chapter 74, Section 4, as amended) is amended to read:
12      "13-4D-4.    ADMINISTRATION.--
13A.   The Public Works Apprentice and Training Act
14 shall be administered by the workforce solutions department.
15 The department shall collect employers' contributions in
16 accordance with that act, review employers' compliance
17 statements, review certified payroll reports to verify
18 training contributions, investigate allegations of and impose
19 penalties for employer noncompliance and disburse funds as
20 provided in Section 13-4D-5 NMSA 1978.
21B.   Public works construction projects shall not be
22 constructed unless an employer agrees to make contributions
23 to approved apprentice and training programs in New Mexico in
24 which the employer is a participant or to the public works
25 apprentice and training fund administered by the workforce  HB 270

1  solutions department.    Contributions shall be made in the
2  same manner and in the same amount as apprentice and training
3  contributions required pursuant to wage rate determinations
4  made by the department.
5C.   In establishing apprentice and training
6  contributions in wage rate determinations for street,
7  highway, bridge, road, utility and light engineering public
8  works construction projects, the workforce solutions
9  department shall set a contribution of zero for any trade
10 classification for which there is no approved apprentice and
11 training program.
12D.   The workforce solutions department shall adopt
13 rules and regulations necessary to implement the provisions
14 of the Public Works Apprentice and Training Act."
15      SECTION 2.     EFFECTIVE DATE.--The effective date of the
16 provisions of this act is July 1, 2026.  HB 270
