11 RELATING TO SEXUAL OFFENSES; CREATING THE CRIME OF INDECENT
12 EXPOSURE TO A CHILD OUT OF PUBLIC VIEW; PROVIDING A PENALTY.

14 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
15 SECTION 1. A new section of Chapter 30, Article 9 NMSA
16 1978 is enacted to read:

17 "[NEW MATERIAL] INDECENT EXPOSURE TO A CHILD OUT OF PUBLIC

18 VIEW--PENALTY.--
19 A. Indecent exposure to a child out of public view
20 consists of a person eighteen years of age or older knowingly
21 and intentionally exposing the person's primary genital area to
22 a child in a lewd and lascivious manner, when the person and
23 child are in a nonpublic place.
24 B. Whoever commits indecent exposure to a child out
25 of public view is guilty of a fourth degree felony.

1 C. As used in this section:
2 (1) "child" means a person under eighteen
3 years of age; and
4 (2) "primary genital area" means the mons
5 pubis, penis, testicles, mons veneris, vulva or vagina."
