A CONCURRENT RESOLUTION honoring Custer State Park cabin owners and their
property rights.
WHEREAS, when Custer State Park was created, then Governor Vassey encouraged
private citizens to build cabins in the park to attract more visitors; and
WHEREAS, today there are thirty-seven privately owned cabins in the park, on land leased
from Custer State Park; and
WHEREAS, the cabin owners pay property tax on the land leased from Custer County, pay
their lease payments to Custer State Park, and contribute regularly to the needs of the park
through the Custer State Park Foundation; and
WHEREAS, most cabin owners' leases expire in a few years; and
WHEREAS, the recent wind storms in the park have damaged some of the cabins, which
has accentuated the need to create some certainty as to the future of the cabins in the park;
and
WHEREAS, the cabin owners have a long legacy with the park and consider themselves
guardians of the park and its heritage; and
WHEREAS, the cabin owners have property rights that need to be respected and honored,
and time is of the essence to address these issues; and
WHEREAS, the South Dakota Legislature can help these cabin owners by ensuring their
property interests are protected and their place in the legacy of the park and the state
continues;

NOW, THEREFORE, BE IT RESOLVED, by the House of Representatives of the One Hundred
First Legislature of the State of South Dakota, the Senate concurring therein, that the
Legislature endorses the cabin owners' property rights in Custer State Park, and their desire
to know their future in the park, and encourages the state to embrace the cabin owners as
important to the park's future; and
BE IT FURTHER RESOLVED, that the Governor and the Department of Game, Fish and
Parks be encouraged to create new leases with the cabin owners, so the cabin owners may
secure their future and enhance the park as quickly as possible.
