SYNOPSIS AS INTRODUCED:
305 ILCS 5/12-4.60 new
Amends the Administration Article of the Illinois Public Aid Code. Provides that notwithstanding any other law and subject to federal approval, if required, the Department of Human Services shall not collect or initiate any debt collection action to recoup any overpayment in Supplemental Nutrition Assistance Program (SNAP) benefits that was made to a SNAP recipient as a result of agency error. Requires the Department to apply for any federal waivers or approvals necessary to implement the amendatory Act.

1 AN ACT concerning public aid.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Public Aid Code is amended by
5 adding Section 12-4.60 as follows:
6 (305 ILCS 5/12-4.60 new)
7 Sec. 12-4.60. SNAP overpayment; agency error.
8 (a) As used in the Section, "SNAP" means the federal
9 Supplemental Nutrition Assistance Program.
10 (b) Notwithstanding any other law and subject to federal
11 approval, if required, the Department of Human Services shall
12 not collect or initiate any debt collection action to recoup
13 any overpayment in SNAP benefits that was made to a SNAP
14 recipient as a result of agency error. The Department shall
15 apply for any federal waivers or approvals necessary to
16 implement this Section.
