Provides that notwithstanding any other law and subject to federal approval, if required, the Department of Human Services shall not collect or initiate any debt collection action to recoup any overpayment in Supplemental Nutrition Assistance Program (SNAP) benefits that was made to a SNAP recipient as a result of agency error. Requires the Department to apply for any federal waivers or approvals necessary to implement the amendatory Act.LRB104 19040 KTG 32485 bA BILL FORSB3360 LRB104 19040 KTG 32485 b1 AN ACT concerning public aid.2 Be it enacted by the People of the State of Illinois,3 represented in the General Assembly:4 Section 5. The Illinois Public Aid Code is amended by5 adding Section 12-4.60 as follows:6 (305 ILCS 5/12-4.60 new)7 Sec. 12-4.60. SNAP overpayment; agency error.8 (a) As used in the Section, "SNAP" means the federal9 Supplemental Nutrition Assistance Program.10 (b) Notwithstanding any other law and subject to federal11 approval, if required, the Department of Human Services shall12 not collect or initiate any debt collection action to recoup13 any overpayment in SNAP benefits that was made to a SNAP14 recipient as a result of agency error. The Department shall15 apply for any federal waivers or approvals necessary to16 implement this Section.
Amends the Administration Article of the Illinois Public Aid Code.
