Subject: Motor vehicles; secondary enforcement; searches
Statement of purpose of bill as introduced: This bill proposes to designate the
following motor vehicle violations as violations that may only be enforced if a
law enforcement officer has detained the operator of a vehicle for another
suspected violation: (1) failure to carry a registration certificate; (2) failure to
display unobstructed license plate numbers; (3) failure to display a license
plate on a trailer or semitrailer; (4) operation without a valid license under
certain circumstances; (5) operation by an individual with a learner’s permit
without a licensed driver in the vehicle; (6) operation on the right side of the
highway; (7) prolonged idling; (8) operation with an obstructed windshield or
windows; (9) operation of an uninspected motor vehicle; (10) operation with a
single broken taillight or brake light; (11) failure to signal a lane change or

turn; (12) impeding traffic with a slow-moving vehicle; and (13) operating a
vehicle with an overly loud muffler. This bill also proposes to prohibit law
enforcement officers from requesting consent for a search of a vehicle or
vehicle operator or passenger following a stop for a moving violation.
