hf2583/enrolled.txtHouseFile2583-EnrolledHouseFile2583ANACTRELATINGTOEMERGENCYPLANNINGANDCOORDINATIONFORELECTRICTRANSMISSIONLINEOWNERS,ANDPROVIDINGPENALTIES.BEITENACTEDBYTHEGENERALASSEMBLYOFTHESTATEOFIOWA:Section1.NEWSECTION.478.34Electrictransmissionemergencyplanningandcoordination.1.Forpurposesofthissection:a.“Electrictransmissionline”meansahigh-voltageelectrictransmissionlinewithacapacityoftwohundredkilovoltsormorethathasbeenapprovedforconstructiononorafterJuly1,2022,forconstructioninafederallyregisteredHouseFile2583,p.2planningauthoritytransmissionplanwithcostsallocatedregionally.b.“Electrictransmissionlineowner”meansanindividualorentitythatownsandmaintainsanelectrictransmissionline.c.“Proclaimeddisasteremergency”meansastateofdisasteremergencyproclaimedbythegovernorpursuanttosection29C.6.2.a.Anelectrictransmissionlineownershallindependentlydevelopanemergencyresponseplanandsubmittheplantothecommission.Theplanshallcontainatleastallofthefollowinginformation:(1)Thename,title,andtwenty-four-hourcontactinformationofatleasttwodesignatedindividualswiththeauthoritytocoordinateanddirecttheelectrictransmissionlineowner’semergencyresponseandrestorationefforts.Eachelectrictransmissionlineownershallnotifythecommissionofanychangetothiscontactinformationwithintwenty-fourhoursofthechangeoccurring.(2)Proceduresfornotifyingstateandlocalemergencymanagementagenciesandneighboringutilitiesduringaserviceinterruption.(3)Strategiesforthestagingandmobilizationofpersonnel,equipment,andmaterialsforexpeditiousrestoration.(4)Asummaryofmutualaidarrangementswithotherentitiesforsupplementalrepaircrewsandequipment.(5)Amethodologyforprioritizingtherestorationofservicetoessentialfacilities,includinghospitals,watertreatmentplants,andpublicsafetycommunications.b.Anelectrictransmissionlineownercurrentlyconstructing,operating,ormaintaininganelectrictransmissionlineorwhohasbeenissuedafranchiseundersection478.4shallsubmitaninitialemergencyresponseplantothecommissionbyDecember31,2026.Updatedplansshallbesubmittedannuallythereafter,orwithinthirtydaysofamaterialchange,intheformandmannerprescribedbythecommission.Anelectrictransmissionlineownerwhoseekstoconstructanelectrictransmissionline,andwhohasnotpreviouslyfiledanemergencyresponseplanwiththecommission,shallfileaninitialemergencyresponseplanHouseFile2583,p.3withthecommissionwithinninetydaysafterthefilingofapetitionundersection478.2.c.Anemergencyresponseplanorinformationsubmittedpursuanttothissectionshallbeconsideredaconfidentialrecordandshallbekeptconfidential,asprovidedinsection22.7,subsection50.Therecordsshallnotbesubjecttodisclosure,exceptasnecessaryforthecoordinationofemergencyresponseandrestorationeffortsbetweenauthorizedstateandutilitypersonnel.3.a.Anelectrictransmissionlineownershallnotifythecommissionintheformandmannerprescribedbythecommissionwhenitisprojected,afteraninitialassessmentofthenatureandscopeofthedamagetothetransmissionlineandinitialinformationfromanyimpactedutilityprovidingelectricitytoendusercustomers,thatanoutagemayresultinalossofservicetoendusercustomersformorethansixhours,providedtheoutagemeetsthecriteriaforasignificantinterruption,asdefinedbycommissionrule.Notificationshallbemadeattheearliestpossibletimeafterthedeterminationandshallincludeallofthefollowing:(1)Thegeneralnatureandcauseoftheinterruption.(2)Thegeographicareaoftheaffectedendusercustomersandtheimpactedfranchise.(3)Apreliminaryassessmentoftheextentofdamage.(4)Theestimatedtimeforrestoration.b.Thenoticerequiredunderparagraph“a”shallbesupplementedasmorecompleteoraccurateinformationbecomesavailable,includingupdatestotheestimatedrestorationtime.4.Intheeventofanactualorimminentproclaimeddisasteremergency,theelectrictransmissionlineownersshallcoordinateoperationalresponseswitheachother,asnecessary,forrepairandrestorationtooccurinanexpeditiousandorderlymanner,andshallprovidethecommissionandthedepartmentofhomelandsecurityandemergencymanagementwithinformationasrequestedtofacilitatestate-levelemergencyresponsedecisionmakingandassistance.5.Anelectrictransmissionlineownerthatviolatesanyprovisionofthissectionoranyruleadoptedpursuanttothissectionissubjecttoacivilpenalty,whichmaybeleviedHouseFile2583,p.4bythecommission,ofnotmorethanonethousanddollarsperviolationortenthousanddollarsperdayofacontinuingviolation,whicheverisgreater.______________________________PATGRASSLEYSpeakeroftheHouse______________________________AMYSINCLAIRPresidentoftheSenateIherebycertifythatthisbilloriginatedintheHouseandisknownasHouseFile2583,Ninety-firstGeneralAssembly.______________________________MEGHANNELSONChiefClerkoftheHouseApproved_______________,2026______________________________KIMREYNOLDSGovernor
