hf2584/amended.txtHouseFile2584-ReprintedHOUSEFILE2584BYCOMMITTEEONPUBLICSAFETY(SUCCESSORTOHSB705)(AsAmendedandPassedbytheHouseFebruary25,2026)ABILLFORAnActestablishingdrug-freehomelessservicezones,and1providingpenalties.2BEITENACTEDBYTHEGENERALASSEMBLYOFTHESTATEOFIOWA:3HF2584(2)91as/js/mdH.F.2584Section1.NEWSECTION.716.15Drug-freehomelessservice1zones.21.Apersoncommitsaviolationofthissectionifthe3personintentionallyorknowinglydoesanyofthefollowing:4a.Thepersonispresentwithinadrug-freehomeless5servicezoneandunlawfullysellsortransfersorattemptsto6unlawfullysellortransferacontrolledsubstance.7b.Thepersonoperatesorhasauthoritytoenforcethe8policiesandrequirementsofafacility-baseddrug-free9homelessservicezonethatprimarilyserveshomeless10individualsandthatreceivesstate,local,orfederalfunding,11andthepersonallowsanindividualaccessingservicesto12unlawfullypossessoruseacontrolledsubstanceonthe13premisesofthefacility.142.Anoffenseundersubsection1,paragraph“a”,is15punishableasthesameclassofcriminalviolationforwhich16theoffensewouldbepunishableunderexistinglawhadthe17violationnotoccurredwithinadrug-freehomelessservice18zone,exceptthatthepresumptive,minimum,andmaximum19sentencefortheoffenseshallbeincreasedbyoneyear.20Theadditionalsentenceimposedunderthissubsectionisin21additiontoanyenhancedpunishmentthatmaybeapplicable22undersubsection4.Notwithstandinganyotherlawtothe23contrary,apersonconvictedunderthissectionisnoteligible24foradeferredjudgment,adeferredorsuspendedsentence,25probation,orworkrelease.263.Apersonwhoisconvictedofaviolationofsubsection1,27paragraph“b”,isguiltyofanaggravatedmisdemeanor.284.Anoperatorofafacility-baseddrug-freehomeless29servicezonewhoviolatessubsection1,paragraph“b”,is30ineligibletoapplyforhomelessnessassistancegrantsfromthe31stateforaperiodofthreeyearsfromthedateofconviction32unlesstheoperatorterminatestheemploymentofanyemployee33orvolunteerwhocommitsaviolationofsubsection1,paragraph34“b”.35-1-HF2584(2)91as/js/md1/3H.F.25845.Inadditiontoanyotherpenalty,apersonconvicted1ofanoffenseunderthistitleshallbepunishedbyafineof2notlessthantwothousanddollarsorthreetimesthevalue3asdeterminedbythecourtofthedrugsinvolvedinorgiving4risetotheoffense,whicheverisgreater.Nofineunder5thissubsectionshallbesuspended,inpartorwhole,forany6reason.76.a.Eachoperatorofafacility-basedservicethat8primarilyservehomelessindividualsshallplaceandmaintain9permanentlyaffixedsignslocatedinaconspicuousmanner10clearlyvisibletothepublicatthemainentranceofthe11facilitythatidentifiesthebuildinganditsaccompanying12groundsasadrug-freehomelessservicezone.Suchsignsshall13bewritteninbothEnglishandSpanishandincontrasting14colorswithblocklettersatleastoneinchinheight.15b.Ifthefacility-basedserviceprovidesshelteror16housingforchildrenorvictimsofdomesticviolencethat17maybeendangeredifthepurposeorlocationofthefacility18becameknown,atleastonesignshallbepermanentlyaffixed19inavisiblemannerinsidethebuildingwithinfivefeetof20themainentranceofthefacilitythatidentifiesthebuilding21anditsaccompanyinggroundsasadrug-freehomelessservice22zone.SuchsignsshallbewritteninbothEnglishandSpanish23andincontrastingcolorswithblocklettersatleastoneinch24inheight.257.Forthepurposesofthissection:26a.“Drug-freehomelessservicezone”meanstheareawithin27threehundredfeetofthepremisesofafacility-basedservice.28b.“Facility-basedservice”meansanyemergencyortemporary29shelter,transitionalhousingprovider,oroperator-owned30permanentsupportivehousingentitythatreceivesgovernment31fundingforthepurposeofprovidingsheltertohomeless32persons.33c.“Operator”meansthesoleproprietorship,organization,34association,corporation,partnership,jointventure,limited35-2-HF2584(2)91as/js/md2/3H.F.2584partnership,limitedliabilitypartnership,limitedliability1company,orotherentityorbusinessassociationthatisthe2directrecipientofgovernmentfundingfortheprovisionof3facility-basedservices.4-3-HF2584(2)91as/js/md3/3
