SB5736YH(6)91ak/ko3/5H.F.2665EXPLANATION1Theinclusionofthisexplanationdoesnotconstituteagreementwith2theexplanation’ssubstancebythemembersofthegeneralassembly.3Thisbillrelatestoradonmitigationrequirementsandtax4credits.5DIVISIONI——RADONMITIGATION——STATEBUILDINGCODE.The6billrequiresthatthestatebuildingcodecommissioneradopt,7aspartofthestatebuildingcode,thatnewsingle-familyor8two-familyresidentialconstructionstartingafteradoptionof9thebuildingcodemustincludepassivemethodsformitigation10ofradon.11DIVISIONII——RADONMITIGATIONTAXCREDIT.Thebillcreates12aradonmitigationsystemtaxcredit(credit)availableagainst13theindividualandcorporateincometaxes.Underthebill,14thecreditisequaltotheamountofthecosttopurchaseand15installaradonmitigationsystem,nottoexceed$1,000.Any16creditinexcessofthetaxpayer’sliabilityisnotrefundable17butmaybecreditedtothetaxliabilityforthefollowingtax18year.Thebilldefines“radonmitigationsystem”(system)to19meanasystemdesignedtomitigatethepresenceofradonina20buildinginstalledbyapersoncertifiedinaccordancewith21Codechapter136B.ThecreditappliesretroactivelytoJanuary221,2025,fortaxyearsbeginningonorafterthatdate.23DIVISIONIII——RADONMITIGATION——RENTALPROPERTIES.The24billprovidesthatatenantmayconductaradontest(test)25orhireapersoncertifiedinaccordancewithCodechapter26136Btoconductatest.Thetenantshallnotifythelandlord27ofatestresultequaltoorgreaterthanfourpicocuries28perliter(4pCi/L),whichistheUnitedStatesenvironmental29protectionagency’sactionlevelforradon.Thelandlordmay30haveaconfirmatorytestconductedbyacertifiedpersonand31mustnotifythetenantofthoseresults.Ifasubsequent32testresultisequaltoorgreaterthan4pCi/L,orifthe33landlordchoosesnottohaveasubsequenttestconducted,the34landlordshallhaveasysteminstalled.Onceasystemhas35-4-LSB5736YH(6)91ak/ko4/5H.F.2665beeninstalled,therentalpropertyshallberetestedandthe1resultsshallbegiventothetenantwithin90days.2Thebillprovidesthatifthelandlordfailstohavea3systeminstalled,orifasystemisinstalledandradontest4resultsremainequaltoorgreaterthan4pCi/L,thetenantmay5terminatetheleasewithproperwrittennotice.Uponreceipt6ofthisnotice,thelandlordcannotimposeanypenaltyfor7terminationoftheleaseagainstthetenantandmustreturnall8prepaidrentandtherentaldeposit.9DIVISIONIV——APPROPRIATION——RADONTESTKITS.Thebill10appropriates$100,000fromthegeneralfundtothedepartment11ofhealthandhumanservices(HHS)forthefiscalyear12beginningJuly1,2026,andendingJune30,2027,tomakeradon13testkitsavailablefreeofchargetohomeownersandrentersin14thestate.HHSisrequiredtoprovidealinkonitsinternet15siteforhomeownersandrenterstoorderradontestkits.16-5-LSB5736YH(6)91ak/ko5/5
