In Colorado Revised Statutes, 18-3-203, amend(1)(c), (1)(c.5); and add (2)(c)(III) as follows:18-3-203. Assault in the second degree.(1) A person commits the crime of assault in the second degree if:(c) With intent to prevent one whom he or she THE PERSON knows,or should know, to be a peace officer, firefighter, emergency medical careprovider, or emergency medical service provider from performing a lawful________Capital letters or bold & italic numbers indicate new material added to existing law; dashesthrough words or numbers indicate deletions from existing law and such material is not part ofthe act.duty, he or she THE PERSON intentionally causes bodily injury to anyANOTHER person; or(c.5) With intent to prevent one whom he or she THE PERSON knows,or should know, to be a peace officer, firefighter, or emergency medicalservice provider from performing a lawful duty, he or she THE PERSONintentionally causes serious bodily injury to any ANOTHER person; or(2) (c) (III) WHEN A DEFENDANT IS CONVICTED OF ASSAULT IN THESECOND DEGREE PURSUANT TO SUBSECTION (1)(i) OF THIS SECTION AND HASBEEN PREVIOUSLY CONVICTED OF CHARGES, WHICH WERE SEPARATELYBROUGHT AND TRIED PRIOR TO THE COMMISSION OF THE PRESENT ACT, FORASSAULT IN THE SECOND DEGREE PURSUANT TO SUBSECTION (1)(i) OF THISSECTION, A COURT SHALL SENTENCE THE DEFENDANT IN ACCORDANCE WITHSECTION 18-1.3-406. A PREVIOUS CONVICTION MUST BE SET FORTH IN THECOMPLAINT, INDICTMENT, OR INFORMATION FOR THE PRESENT ACT.SECTION 2. Act subject to petition - effective date -applicability.
