sb0328/introduced.txt02-27 16:16 S.B. 3281Municipal Service District Amendments2026 GENERAL SESSIONSTATE OF UTAHChief Sponsor: Jen PlumbHouse Sponsor:23 LONG TITLE4 General Description:5This bill modifies provisions regarding municipal services districts.6 Highlighted Provisions:7This bill:8▸ requires a municipal services district to fulfill certain duties when providing planning or9 zoning services to a municipality;10▸ requires a municipal services district to ensure that at least one board member or one11 district employee is available in any public meeting in which a municipal legislative12 body considers a recommendation or proposal regarding planning or zoning that is13 prepared by the municipal services district; and14▸ makes technical and conforming changes.15 Money Appropriated in this Bill:16None17 Other Special Clauses:18None19 Utah Code Sections Affected:20 AMENDS:2117B-2a-1112, as enacted by Laws of Utah 2015, Chapter 3522223 Be it enacted by the Legislature of the state of Utah:S.B. 32824Section 1. Section 17B-2a-1112 is amended to read:2517B-2a-1112 . Audit -- Transparency in certain municipal services.26 (1) The board of trustees shall provide a copy of an accounting report, as defined in27Section 51-2a-102, to each political subdivision that is provided municipal services by28the municipal services district that is filed with the state auditor on behalf of the29municipal services district in accordance with Section 51-2a-203.30 (2) When the district provides a municipal services to a municipality within the district'sS.B. 328 02-27 16:1631 service area in regard to a proposal for planning or zoning, the district shall:32 (a) provide notice on the district's website that the district is engaged in a planning or33zoning project for the municipality;34 (b) analyze the potential impact of a proposed planning or zoning action on property35values within the municipality that may adopt the proposal;36 (c) provide the district's analysis described in Subsection (2)(b) with the proposal to the37municipality;38 (d) consult with an independent third party to assess potential unintended consequences39of a proposed planning or zoning action on residents and property owners within a40municipality;41 (e) identify properties, if any, that would be adversely affected by a proposed planning42or zoning action, including by address, parcel number, general description of type of43property, or another method that reasonably informs the municipality considering the44proposal; and45 (f) provide any results of the consultation described in Subsection (2)(d) with the46proposal to the municipality.47 (3) A municipal services district shall ensure that at least one board member or one district48 employee is available to answer questions and present information in any public meeting49 of a municipality in which a municipal legislative body considers a recommendation or50 proposal regarding planning or zoning that is prepared by the municipal services district.51Section 2. Effective Date.52 This bill takes effect on May 6, 2026.-2-
