3   LONG TITLE
4   General Description:
5This bill modifies provisions regarding municipal services districts.
6   Highlighted Provisions:
7This bill:
8▸ requires a municipal services district to fulfill certain duties when providing planning or
9   zoning services to a municipality;
10▸ requires a municipal services district to ensure that at least one board member or one
11   district employee is available in any public meeting in which a municipal legislative
12   body considers a recommendation or proposal regarding planning or zoning that is
13   prepared by the municipal services district; and
14▸ makes technical and conforming changes.

23   Be it enacted by the Legislature of the state of Utah:

24Section 1. Section 17B-2a-1112 is amended to read:
2517B-2a-1112 . Audit -- Transparency in certain municipal services.
26   (1) The board of trustees shall provide a copy of an accounting report, as defined in
27Section 51-2a-102, to each political subdivision that is provided municipal services by
28the municipal services district that is filed with the state auditor on behalf of the
29municipal services district in accordance with Section 51-2a-203.
30   (2) When the district provides a municipal services to a municipality within the district's

31      service area in regard to a proposal for planning or zoning, the district shall:
32      (a) provide notice on the district's website that the district is engaged in a planning or
33zoning project for the municipality;
34      (b) analyze the potential impact of a proposed planning or zoning action on property
35values within the municipality that may adopt the proposal;
36      (c) provide the district's analysis described in Subsection (2)(b) with the proposal to the
37municipality;
38      (d) consult with an independent third party to assess potential unintended consequences
39of a proposed planning or zoning action on residents and property owners within a
40municipality;
41      (e) identify properties, if any, that would be adversely affected by a proposed planning
42or zoning action, including by address, parcel number, general description of type of
43property, or another method that reasonably informs the municipality considering the
44proposal; and
45      (f) provide any results of the consultation described in Subsection (2)(d) with the
46proposal to the municipality.
47  (3) A municipal services district shall ensure that at least one board member or one district
48      employee is available to answer questions and present information in any public meeting
49      of a municipality in which a municipal legislative body considers a recommendation or
50      proposal regarding planning or zoning that is prepared by the municipal services district.
51Section 2. Effective Date.
52  This bill takes effect on May 6, 2026.
