A JOINT RESOLUTION directing the establishment of the Real Estate
Modernization Task Force.
WHEREAS, the General Assembly has not updated many of Kentucky's real
property laws since the statute laws of this Commonwealth were codified in the Kentucky
Revised Statutes; and
WHEREAS, the General Assembly wishes to examine ways in which the real
property laws of the Commonwealth may be updated and modernized to best serve
Kentuckians;
NOW, THEREFORE,
Be it resolved by the General Assembly of the Commonwealth of Kentucky:
Section 1. The Legislative Research Commission is directed to establish the
Real Estate Modernization Task Force. The task force shall:
(1) Study methods and approaches to protect against fraud in real estate
transactions;
(2) Conduct a review of the real property laws of the Commonwealth and identify
any areas for modernization; and
(3) Study any other topic or issue relating to real property or housing that the task
force determines is appropriate.
Section 2. The Real Estate Modernization Task Force shall be composed of the
following members, with final membership of the task force being subject to the
consideration and approval of the Legislative Research Commission:
(1) Four members of the House of Representatives, including three members
appointed by the Speaker of the House of Representatives, one of whom shall be
designated to serve as co-chair, and one member appointed by the Minority Floor Leader
of the House of Representatives;
(2) Four members of the Senate, including three members appointed by the
President of the Senate, one of whom shall be designated to serve as co-chair, and one

member appointed by the Minority Floor Leader of the Senate;
(3) The Attorney General;
(4) The secretary of the Public Protection Cabinet;
(5) One member representing the Kentucky County Clerks Association;
(6) One member representing the Kentucky Association of Realtors;
(7) One member representing mortgage brokers; and
(8) One member representing title companies.
Section 3. The Real Estate Modernization Task Force shall meet at least
monthly during the 2026 Interim of the General Assembly and shall submit its findings,
legislative recommendations, or a memorandum to the Legislative Research Commission
no later than December 1, 2026. If legislative recommendations are submitted, the
Legislative Research Commission may refer the recommendations to the appropriate
committee or committees of jurisdiction in advance of the 2027 Regular Session of the
General Assembly.

Direct the Legislative Research Commission to establish the Real Estate Modernization Task Force to conduct a review of the real property laws of the Commonwealth; establish task force membership; require the task force to meet at least monthly during the 2026 Interim; require the task force to submit its findings and recommendations to the Legislative Research Commission by December 1, 2026.
