9Relating to Mobile County; to require certain boards of
10 water and sewer commissioners to convey a conservation
11 easement for certain real property parcels.
12 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
13Section 1. (a) For purposes of this section, the
14 following terms have the following meanings:
15(1) CONSERVATION EASEMENT. The same meaning as provided
16 in Section 35-18-1, Code of Alabama 1975.
17(2) CONSERVATION EASEMENT HOLDER. A charitable
18 corporation, charitable association, or charitable trust, the
19 purposes or powers of which include retaining or protecting
20 the natural, scenic, or open-space values of real property;
21 assuring the availability of real property for agricultural,
22 silvicultural, forest, recreational, or open-space use;
23 protecting natural resources, maintaining, or enhancing air or
24 water quality; or preserving the historical, architectural,
25 archaeological, paleontological, or cultural aspects of real
26 property.
27(b) Any board of water and sewer commissioners
28 established and organized under Act 775 of the 1951 Regular

29 Session (Acts 1951, pg. 1359), or successor entity, that owns
30 one or more of the following real property parcels within
31 Mobile County, not later than October 1, 2027, shall convey a
32 conservation easement for each parcel to a conservation
33 easement holder:

87 Road right of way.
88(c) Nothing in this section shall be construed to
89 exempt any board of water and sewer commissioners or any other
90 party from any law that would otherwise apply to the
91 conveyance of a conservation easement.
92Section 2. This act shall become effective on October
93 1, 2026.
