  To enact section 4731.2211 of the Revised Code to  1
  authorize a physician whose license was revoked  2
  to apply for reinstatement.  3
 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
     Section 1. That section 4731.2211 of the Revised Code be  4
enacted to read as follows:  5
     Sec. 4731.2211. (A)(1) An individual whose license to  6
practice medicine and surgery or osteopathic medicine and  7
surgery was revoked under section 4731.22 of the Revised Code  8
may apply to the state medical board for reinstatement of the  9
individual's license.  10
     (2) An applicant shall submit to the board a written  11
application on a form prescribed and supplied by the board. The  12
application shall include all the information the board  13
considers necessary to process it. An applicant shall include  14
with the application a fee of six hundred ten dollars, no part  15
of which may be returned. An application is not considered  16
submitted until the board receives the fee.  17
     (3) As part of an application, an applicant may request an  18
adjudicatory hearing by the board.  19
     (B) The board shall accept an application for  20

reinstatement submitted under this section as follows:  21
        (1) Only if submitted after the date that is five years  22
after the date the board issued its order revoking the  23
applicant's license, except that in the case of an applicant  24
whose license was revoked under division (B)(19) or (26) of  25
section 4731.22 of the Revised Code, the board shall accept an  26
application submitted on any date that is after the date the  27
board issued its revocation order;  28
        (2) In the case of an applicant whose license was revoked  29
under division (B)(6) of section 4731.22 of the Revised Code,  30
only if the grounds for revocation under that section involved  31
an act constituting a misdemeanor offense;  32
        (3) In the case of an applicant whose license was revoked  33
under division (B)(9) or (10) of section 4731.22 of the Revised  34
Code, only if the felony offense that was the grounds for  35
revocation under that section was neither violent nor related to  36
patient care;  37
        (4) Even if the board, when revoking an applicant's  38
license, specified under division (L) of section 4731.22 of the  39
Revised Code that its action was permanent.  40
        (C) To be eligible for reinstatement under this section,  41
an applicant shall demonstrate that all of the following are the  42
case:  43
        (1) The applicant participated in one or more community  44
service or professional volunteer activities or programs while  45
the license was revoked.  46
        (2) In the case of an applicant whose license was revoked  47
under division (B)(19) of section 4731.22 of the Revised Code,  48
the applicant has been treated for the underlying mental or  49

physical illness by a provider recognized in accordance with  50
this chapter.  51
       (3) In the case of an applicant whose license was revoked  52
under division (B)(26) of section 4731.22 of the Revised Code,  53
the applicant successfully completed a treatment program  54
conducted by a treatment provider approved in accordance with  55
this chapter.  56
       (4) The applicant has complied with all terms specified in  57
the board's order revoking the license, including paying any  58
fines or costs imposed by the board.  59
       (5) The applicant has successfully completed, for each  60
year the applicant's license has been revoked, at least twenty-  61
five hours of continuing medical education approved by the board  62
or has read an equivalent amount of literature relevant to the  63
applicant's practice specialty as determined by the board.  64
       (6) The applicant has undergone an evaluation of the  65
applicant's professional skills and knowledge conducted by an  66
individual or entity trained or otherwise qualified to do so,  67
and a written assessment prepared by the individual or entity  68
conducting the evaluation demonstrates that the applicant has  69
the professional skills and knowledge necessary to practice  70
medicine and surgery or osteopathic medicine and surgery.  71
       (7) The applicant seeks in good faith to be reinstated to  72
the privilege of practicing medicine and surgery or osteopathic  73
medicine and surgery in this state.  74
       (D)(1) The board shall review and consider each  75
application for reinstatement it accepts. Following its review  76
and consideration and, if requested, the adjudicatory hearing  77
described in division (A)(3) of this section, the board may  78

reinstate the applicant's license if it finds, by clear and  79
convincing evidence, both of the following:  80
       (a) That the requirements of division (C) of this section  81
have been met;  82
       (b) That the applicant is of good moral character, is able  83
to practice with reasonable skill and safety to patients, and  84
should be permitted in the public interest to practice medicine  85
and surgery or osteopathic medicine and surgery.  86
       (2) The board shall not reinstate a license unless the  87
applicant complies with sections 4776.01 to 4776.04 of the  88
Revised Code and the board, in its discretion, decides that the  89
results of the criminal records check do not make the applicant  90
ineligible for a license to practice medicine and surgery or  91
osteopathic medicine and surgery.  92
       (3) In the case of an applicant whose license was revoked  93
under division (B)(19) of section 4731.22 of the Revised Code,  94
the board shall not reinstate the applicant's license until it  95
finds that the applicant is mentally and physically able to  96
practice medicine and surgery or osteopathic medicine and  97
surgery with reasonable skill and safety to patients.  98
       (E) If the board reinstates a license under this section,  99
then both of the following apply:  100
       (1) The board shall impose both of the following terms and  101
conditions on the license holder:  102
       (a) Placing the holder on probation for a one-year period  103
under conditions set by the board;  104
       (b) Requiring the holder to successfully pass an  105
examination prescribed by the board to determine competency to  106

practice medicine and surgery or osteopathic medicine and  107
surgery.  108
       (2) The board may impose additional terms and conditions  109
on the license holder, including the following:  110
       (a) In the case of a holder described in division (C)(2)  111
of this section, requiring the holder to undergo, on a regular  112
basis, an examination of the holder's mental or physical  113
abilities conducted by an individual or entity trained or  114
otherwise qualified to do so and to demonstrate, based on a  115
written assessment prepared by the individual or entity  116
conducting the examination, that the holder has the mental or  117
physical skills necessary to practice medicine and surgery or  118
osteopathic medicine and surgery;  119
       (b) Requiring the holder to participate in didactic and  120
clinical coursework or training approved by the board in order  121
to become competent or proficient in areas of practice that the  122
board finds deficient.  123
       (F) The board may adopt any rules it considers necessary  124
to implement this section. The rules shall be adopted in  125
accordance with Chapter 119. of the Revised Code.  126
