s1436/introduced.txtLEGISLATURE OF THE STATE OF IDAHOSixty-eighth Legislature Second Regular Session - 2026IN THE SENATESENATE BILL NO. 1436BY STATE AFFAIRS COMMITTEE1AN ACT2 RELATING TO STATE PROCUREMENT; AMENDING SECTION 67-9224, IDAHO CODE, TO RE-3 VISE PROVISIONS REGARDING COOPERATIVE AND GROUP DISCOUNT PURCHASING;4 AND DECLARING AN EMERGENCY.5 Be It Enacted by the Legislature of the State of Idaho:6 SECTION 1. That Section 67-9224, Idaho Code, be, and the same is hereby7 amended to read as follows:867-9224. COOPERATIVE AND GROUP DISCOUNT PURCHASING. (1) The9 Notwithstanding any provision of this chapter to the contrary, the adminis-10 trator may authorize an agency to:11 (a) Become a participating member of a group discount purchasing organ-12 ization;13 (b) Participate in, sponsor, conduct or administer a cooperative pur-14 chasing agreement for property with one (1) or more public agencies, in-15 dependent of the requirements of section 67-2329, Idaho Code; or16 (c) Utilize contracts of other public agencies within this state upon17 determining that the contract was let in a manner that constitutes com-18 petitive bidding consistent with the requirements of this chapter and19 is otherwise in the best interest of the state.20 (2) Any contracts entered into pursuant to subsection (1) of this sec-21 tion may include modifications to address additional needs of the state if22 the administrator determines the modifications are in the best interest of23 the state. The administrator shall inform the vendor of the manner in which24 the state may request modifications prior to entering such contract.25 (2) (3) The state's participation in a cooperative purchase or group26 discount purchasing organization must be formalized by a written agreement.27 (3) (4) The state's entrance fee or participation fee in a group dis-28 count purchasing organization must be based on criteria applied to all other29 members of the organization.30 (4) (5) Any agreement entered into pursuant to subsection (2) (3) of31 this section shall be maintained on file with the division as well as with the32 agency entering into the agreement.33 (6) The legislature finds and declares that group discount purchasing,34 cooperative purchasing, and shared contracts reduce administrative burden35 to the state by requiring fewer solicitations. The legislature further36 finds and declares that group discount purchasing, cooperative purchasing,37 and shared contracts may enable the state to procure property for reduced38 cost. It is the intent of the legislature to authorize such activities in a39 manner that allows flexibility to modify underlying contracts when the modi-40 fication, in the administrator's judgment, would serve the best interest of41 the state.21 SECTION 2. An emergency existing therefor, which emergency is hereby2 declared to exist, this act shall be in full force and effect on and after its3 passage and approval.
