1A CONCURRENT RESOLUTION
2  STATING FINDINGS OF THE LEGISLATURE AND URGING THE CITIZENS OF IDAHO TO RE-
3      JECT ANY EFFORT TO BRING THE IDAHO MEDICAL CANNABIS ACT TO THE BALLOT.
4  Be It Resolved by the Legislature of the State of Idaho:
5WHEREAS, the legalization of marijuana in other states has led to in-
6  creased cartel activity, development of black market marijuana production,
7  human trafficking, and increased crime rates, including violent crime and
8  impaired driving; and
9WHEREAS, the legalization of marijuana in other states has led to in-
10 creased rates of serious health issues, including psychosis, anxiety, de-
11 pression, suicidal ideation, marijuana-linked vomiting or cannabinoid hy-
12 peremesis syndrome, cardiac issues, strokes, addiction, diabetes, and harm
13 to children in the womb; and
14      WHEREAS, the legalization of marijuana in other states has led to ille-
15 gal grow sites on federal and state lands that have led to deforestation, di-
16 version of water, poisoning of streams, death of wildlife, threats of vio-
17 lence from those protecting illegal marijuana grows, and human trafficking;
18 and
19      WHEREAS, the legalization of marijuana in other states has led to safety
20 concerns on job sites and has negatively impacted the supply of drug-free la-
21 bor; and
22      WHEREAS, the Idaho Medical Cannabis Act may be on the ballot in Idaho as
23 an initiated state statute on November 3, 2026; and
24      WHEREAS, the Idaho Medical Cannabis Act could ultimately allow 12 mar-
25 ijuana production facilities and 36 dispensaries to operate in the State of
26 Idaho and would allow online ordering and home delivery of marijuana; and
27      WHEREAS, the Idaho Medical Cannabis Act would require multiple state
28 agencies and their employees, including the Department of Health and Welfare
29 and the State Board of Pharmacy, to create and administer a statewide program
30 that involves marijuana manufacturing, processing, transportation, and
31 retail sales, including online sales; and
32      WHEREAS, the Idaho Medical Cannabis Act would increase the administra-
33 tive budget of the Department of Health and Welfare by an estimated $1.1 mil-
34 lion annually and require $2.9 million of startup costs at a time when the
35 state is facing substantial budget constraints; and
36      WHEREAS, the Idaho Medical Cannabis Act does not require a medical re-
37 ferral or a prescription to obtain marijuana; and
38      WHEREAS, under the Idaho Medical Cannabis Act, the 18 medical condi-
39 tions that qualify one to obtain a medical cannabis card, including insom-
40 nia, anxiety, and acute pain, are so broad that almost anyone could qualify;
41 and

1WHEREAS, the Idaho Medical Cannabis Act lacks safeguards to such an ex-
2  tent that it would effectively legalize widespread recreational use of mari-
3  juana; and
4WHEREAS, the legalization of marijuana would have devastating impacts
5  on Idaho children and their families.
6NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses-
7  sion of the Sixty-eighth Idaho Legislature, the Senate and the House of Rep-
8  resentatives concurring therein, that the Legislature urges the citizens of
9  Idaho to reject any effort to bring the Idaho Medical Cannabis Act to the bal-
10 lot.
11      BE IT FURTHER RESOLVED that the Secretary of the Senate be, and she is
12 hereby authorized and directed to forward a copy of this Resolution to the
13 Governor of the State of Idaho, the Attorney General, and the congressional
14 delegation representing the State of Idaho in the Congress of the United
15 States.
