1AN ACT
2 To enact R.S. 9:2801(A)(4)(g), relative to retirement benefits received from the Firefighters'
3Retirement System; to provide with respect to the calculation of the community
4portion of such benefits; to provide for effectiveness; and to provide for related
5matters.
6Notice of intention to introduce this Act has been published
7as provided by Article X, Section 29(C) of the Constitution
8of Louisiana.
9 Be it enacted by the Legislature of Louisiana:
10Section 1. R.S. 9:2801(A)(4)(g) is hereby enacted to read as follows:
11§2801. Partition of community property and settlement of claims arising from
12matrimonial regimes and co-ownership of former community property
13A. When the spouses are unable to agree on a partition of community
14property or on the settlement of the claims between the spouses arising either from
15the matrimonial regime, or from the co-ownership of former community property
16following termination of the matrimonial regime, either spouse, as an incident of the
17action that would result in a termination of the matrimonial regime or upon
18termination of the matrimonial regime or thereafter, may institute a proceeding,
19which shall be conducted in accordance with the following rules:

21(4) The court shall then partition the community in accordance with the
22following rules:

24(g) Notwithstanding any provision of law to the contrary, any increase in a
25full-time firefighter's earnable compensation that occurs following termination of a
26community of acquets and gains and that was conditioned on the firefighter's passage

1of both a written examination and a working test shall not be included in the
2calculation of a former spouse's portion of community property.

4Section 2. This Act shall become effective upon signature by the governor or, if not
5 signed by the governor, upon expiration of the time for bills to become law without signature
6 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
7 vetoed by the governor and subsequently approved by the legislature, this Act shall become
8 effective on the day following such approval.
