issue at the 2026 general election, the concurrent resolution amends the
Colorado constitution to prohibit a person from being a state
representative or senator for a term of office that immediately follows a
term for which the person was appointed to fill a vacancy in the general
assembly for that office.
1Be It Resolved by the House of Representatives of the Seventy-fifth
2 General Assembly of the State of Colorado, the Senate concurring herein:
3SECTION 1. At the election held on November 3, 2026, the
4 secretary of state shall submit to the registered electors of the state the
5 ballot title set forth in section 2 for the following amendment to the state
6 constitution:
7In the constitution of the state of Colorado, amend section 4 of
8 article V as follows:
9Section 4. Qualifications of members. (1) No person shall be a
10 representative or senator who shall HAS not have attained the age of
11 twenty-five years, who shall IS not be a citizen of the United States, and
12 who shall HAS not for at least twelve months next preceding his THE
13 PERSON'S election have resided within the territory included in the limits
14 of the district in which he THE PERSON shall be chosen.
15(2) IN ADDITION TO THE REQUIREMENTS SET FORTH IN SUBSECTION
16 (1) OF THIS SECTION, NO PERSON SHALL BE A REPRESENTATIVE OR
17 SENATOR FOR A TERM OF OFFICE THAT IMMEDIATELY FOLLOWS THE
18 UNEXPIRED TERM FOR WHICH THE PERSON WAS APPOINTED TO FILL A
19 VACANCY IN THE SAME DISTRICT.
20SECTION 2. Each elector voting at the election may cast a vote
21 either "Yes/For" or "No/Against" on the following ballot title: "Shall
22 there be an amendment to the Colorado constitution concerning a
23 prohibition on a person being a state legislator for a term of office

1 immediately following the unexpired term for which the person was
2 appointed to fill a vacancy in the same district?"
3SECTION 3. Except as otherwise provided in section 1-40-123,
4 Colorado Revised Statutes, if at least fifty-five percent of the electors
5 voting on the ballot title vote "Yes/For", then the amendment will become
6 part of the state constitution.
