HOUSE BILL NO. 1240 (Substitute for House Bill No. 836 by Representative Hilferty)

LEVEES/BDS & DISTRICTS: Modifies the board of commissioners within the Southeast
Louisiana Flood Protection Authority-East
AN ACT
To enact R.S. 38:330.1(C)(1)(a)(iv), relative to the composition of the board of
commissioners for the Southeast Louisiana Flood Protection Authority-East; to
reconstitute the board of commissioners within the Southeast Louisiana Flood
Protection Authority-East; to provide for reconfirmation of the membership of the
board; and to provide for related matters.
Be it enacted by the Legislature of Louisiana:
Section 1. R.S.38:330.1(C)(1)(a)(iv) is hereby enacted to read as follows:
§330.1. Southeast Louisiana Flood Protection Authority-East and Southeast
Louisiana Flood Protection Authority-West Bank; territorial jurisdiction;
board of commissioners; appointments; terms; compensation; vacancy;
officers; meetings; domicile

C.(1) There is hereby created a board of commissioners for each flood
protection authority as follows:
(a) The board of commissioners of the Southeast Louisiana Flood Protection
Authority-East shall be composed of nine members, one member from St. Bernard
Parish, two members from Jefferson Parish, three members from Orleans Parish who

shall reside within the territorial jurisdiction of the authority, and three members who
do not reside within the territorial jurisdiction of the authority. The members shall
be appointed by the governor from nominations submitted by the nominating
committee as follows:

(iv) Notwithstanding any other provision of law to the contrary, the
composition and membership of the Southeast Louisiana Flood Protection Authority-
East shall be reconstituted and the members as of December 1, 2026 shall be subject
to reconfirmation by the Senate. The failure of the Senate to reconfirm a member
shall be considered an unexpected vacancy and the nominating committee shall
follow the procedure outlined in Paragraph (3) of this Subsection. The term of any
member not reconfirmed by the Senate shall expire immediately and the person shall
not be reappointed as a member for a period of two years. If the member is
reconfirmed the same term applicable to the original appointment shall apply. Any
successor appointed and confirmed pursuant to this Act shall complete the term
originally applicable to their predecessor.

Abstract: Reconstitutes and reconfirms the board of commissioners membership within the
Southeast Louisiana Flood Protection Authority-East.
Present law specifies that the board of commissioners of the Southeast La. Flood Protection
Authority-East be composed of nine members, with specified members residing in certain
parishes within the state. Requires the members be appointed by the governor from
nominations submitted by the nominating committee under specific conditions. Specifies
that within 10 days of an unexpected vacancy of the board, the board must notify the chair
of the nominating committee. Requires notification by the chair be published in the official
journal of the state and of each parish within the territorial jurisdiction of the authority no
later than 30 days of notice of the unexpected vacancy. Requires the nominating committee
meet to determine the notification to send to the governor for appointment to which the
governor must appoint the nominees and submit the appointees to the Senate for
confirmation.

Proposed law requires that, as of Dec. 1, 2026, the composition and membership of the
Southeast La. Flood Protection Authority-East be reconstituted and reconfirmed by the
Senate. Requires any member not confirmed be treated as an unexpected vacancy and the
nominating committee follow the procedures outlined in present law to fill the vacancy.
Specifies that any membership not reconfirmed expires immediately and not be reappointed
for a period of two years. Requires that members reconfirmed possess the same term
requirement as the original appointment and any successor complete the term applicable to
their predecessor.
