REAPPROPRIATION - EDUCATION CENTER/WAREHOUSE ROOF REPAIR -24 FEDERAL. There is hereby appropriated, to the Department of Energy and25 Environment, to be payable from the federal funds as designated by the Chief26 Fiscal Officer of the State, for the Department of Energy and Environment -27 Oil and Gas Commission the following:28(A) Effective July 1, 2026, the balance of the appropriation provided29 in Item (A) of Section 1 of Act 338 of 2025, for roof repair for Education30 Center/Warehouse, in a sum not to exceed ...........................$275,274.3132SECTION 2. REAPPROPRIATION - EDUCATION CENTER/WAREHOUSE ROOF REPAIR -33 CASH. There is hereby appropriated, to the Department of Energy and34 Environment, to be payable from the cash fund deposited in the State Treasury35 as determined by the Chief Fiscal Officer of the State, for the Department of36 Energy and Environment - Oil and Gas Commission the following:*WFP033* 04/14/2026 2:58:50 PM WFP033HB10811 (A) Effective July 1, 2026, the balance of the appropriation provided2 in Item (A) of Section 2 of Act 338 of 2025, for roof repair for Education3 Center/Warehouse, in a sum not to exceed ...........................$296,552.45 SECTION 3. DISBURSEMENT CONTROLS. (A) No contract may be awarded nor6 obligations otherwise incurred in relation to the project or projects7 described herein in excess of the State Treasury funds actually available8 therefor as provided by law. Provided, however, that institutions and9 agencies listed herein shall have the authority to accept and use grants and10 donations including Federal funds, and to use its unobligated cash income or11 funds, or both available to it, for the purpose of supplementing the State12 Treasury funds for financing the entire costs of the project or projects13 enumerated herein. Provided further, that the appropriations and funds14 otherwise provided by the General Assembly for Maintenance and General15 Operations of the agency or institutions receiving appropriation herein shall16 not be used for any of the purposes as appropriated in this act.17 (B) The restrictions of any applicable provisions of the State18 Purchasing Law, the General Accounting and Budgetary Procedures Law, the19 Revenue Stabilization Law and any other applicable fiscal control laws of20 this State and regulations promulgated by the Department of Finance and21 Administration, as authorized by law, shall be strictly complied with in22 disbursement of any funds provided by this act unless specifically provided23 otherwise by law.2425 SECTION 4. LEGISLATIVE INTENT. It is the intent of the General26 Assembly that any funds disbursed under the authority of the appropriations27 contained in this act shall be in compliance with the stated reasons for28 which this act was adopted, as evidenced by the Agency Requests, Executive29 Recommendations and Legislative Recommendations contained in the budget30 manuals prepared by the Department of Finance and Administration, letters, or31 summarized oral testimony in the official minutes of the Arkansas Legislative32 Council or Joint Budget Committee which relate to its passage and adoption.3334 SECTION 5. EMERGENCY CLAUSE. It is found and determined by the General35 Assembly, that the Constitution of the State of Arkansas prohibits the36 appropriation of funds for more than a one (1) year period; that the204/14/2026 2:58:50 PM WFP033HB10811 effectiveness of this Act on July 1, 2026 is essential to the operation of2 the agency for which the appropriations in this Act are provided, and that in3 the event of an extension of the legislative session, the delay in the4 effective date of this Act beyond July 1, 2026 could work irreparable harm5 upon the proper administration and provision of essential governmental6 programs.
