REAPPROPRIATION - DEVELOPMENTAL DISABILITIES SERVICES.24 There is hereby appropriated, to the Department of Human Services, to be25 payable from the federal funds as designated by the Chief Fiscal Officer of26 the State, for the Department of Human Services - Division of Developmental27 Disabilities Services the following:28(A) Effective July 1, 2026, the balance of the appropriation provided29 in Item (A) of Section 1 of Act 133 of 2025, for implementation of the30 residential housing plan of the Booneville Human Development Center master31 plan including costs associated with demolition, construction, replacement,32 renovation, upgrade, and addition of facilities at the Booneville Human33 Development Center, in a sum not to exceed .......................$5,382,921.34(B) Effective July 1, 2026, the balance of the appropriation provided35 in Item (B) of Section 1 of Act 133 of 2025, for continued implementation of36 the master plans at each Human Development Center including demolition,*LCW086* 04/14/2026 2:07:20 PM LCW086HB10821 construction, replacement, upgrade, and addition of facilities, in a sum not2 to exceed ........................................................$7,227,176.34 SECTION 2. DISBURSEMENT CONTROLS. (A) No contract may be awarded nor5 obligations otherwise incurred in relation to the project or projects6 described herein in excess of the State Treasury funds actually available7 therefor as provided by law. Provided, however, that institutions and8 agencies listed herein shall have the authority to accept and use grants and9 donations including Federal funds, and to use its unobligated cash income or10 funds, or both available to it, for the purpose of supplementing the State11 Treasury funds for financing the entire costs of the project or projects12 enumerated herein. Provided further, that the appropriations and funds13 otherwise provided by the General Assembly for Maintenance and General14 Operations of the agency or institutions receiving appropriation herein shall15 not be used for any of the purposes as appropriated in this act.16 (B) The restrictions of any applicable provisions of the State17 Purchasing Law, the General Accounting and Budgetary Procedures Law, the18 Revenue Stabilization Law and any other applicable fiscal control laws of19 this State and regulations promulgated by the Department of Finance and20 Administration, as authorized by law, shall be strictly complied with in21 disbursement of any funds provided by this act unless specifically provided22 otherwise by law.2324 SECTION 3. LEGISLATIVE INTENT. It is the intent of the General25 Assembly that any funds disbursed under the authority of the appropriations26 contained in this act shall be in compliance with the stated reasons for27 which this act was adopted, as evidenced by the Agency Requests, Executive28 Recommendations and Legislative Recommendations contained in the budget29 manuals prepared by the Department of Finance and Administration, letters, or30 summarized oral testimony in the official minutes of the Arkansas Legislative31 Council or Joint Budget Committee which relate to its passage and adoption.3233 SECTION 4. EMERGENCY CLAUSE. It is found and determined by the General34 Assembly, that the Constitution of the State of Arkansas prohibits the35 appropriation of funds for more than a one (1) year period; that the36 effectiveness of this Act on July 1, 2026 is essential to the operation of204/14/2026 2:07:20 PM LCW086HB10821 the agency for which the appropriations in this Act are provided, and that in2 the event of an extension of the legislative session, the delay in the3 effective date of this Act beyond July 1, 2026 could work irreparable harm4 upon the proper administration and provision of essential governmental5 programs.
