9AN ACT TO REAPPROPRIATE THE BALANCES OF CAPITAL
10IMPROVEMENT APPROPRIATIONS FOR THE DEPARTMENT OF THE
11MILITARY; AND FOR OTHER PURPOSES.

16MILITARY REAPPROPRIATION.

18 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:
19
20SECTION 1. REAPPROPRIATION - FEDERAL CAPITAL PROJECTS.  There is hereby
21 appropriated, to the Department of the Military, to be payable from the
22 federal funds as designated by the Chief Fiscal Officer of the State, for the
23 Department of the Military the following:
24(A)    Effective July 1, 2026, the balance of the appropriation provided
25 in Item (A) of Section 2 of Act 97 of 2025, for repair, construction,
26 renovation, expansion, landscaping, maintenance, improvement, or equipping of
27 the Professional Education Center (PEC) at Camp Joseph T. Robinson, in a sum
28 not to exceed ....................................................$6,500,000.
29(B)    Effective July 1, 2026, the balance of the appropriation provided
30 in Item (B) of Section 2 of Act 97 of 2025, for construction of a Readiness
31 Center Joint Force Headquarters at Fort Chaffee, in a sum not to exceed
32 ..................................................................$5,117,313.
33(C)    Effective July 1, 2026, the balance of the appropriation provided
34 in Item (C) of Section 2 of Act 97 of 2025, for a Multi-Purpose Machinegun
35 Range at Camp Joseph T. Robinson, in a sum not to exceed ........$11,206,015.
36(D)    Effective July 1, 2026, the balance of the appropriation provided

1 in Item (D) of Section 2 of Act 97 of 2025, for an RMTC Redundant Water
2 Storage Tank at Camp Joseph T. Robinson, in a sum not to exceed ..$6,840,000.
3      (E)   Effective July 1, 2026, the balance of the appropriation provided
4 in Item (F) of Section 2 of Act 97 of 2025, for a Multi-Purpose Machine gun
5 range at Camp Joseph T. Robinson, in a sum not to exceed .........$8,000,000.
6      (F)   Effective July 1, 2026, the balance of the appropriation provided
7 in Item (G) of Section 2 of Act 97 of 2025, for construction of a Readiness
8 Center at Fort Chaffee, in a sum not to exceed ..................$10,624,628.

10      SECTION 2. REAPPROPRIATION - ARMORY CONSTRUCTION FUND CAPITAL PROJECTS.
11 There is hereby appropriated, to the Department of the Military, to be
12 payable from the Armory Construction Fund, for the Department of the Military
13 the following:
14      (A)   Effective July 1, 2026, the balance of the appropriation provided
15 in Item (A) of Section 3 of Act 97 of 2025, for repair, construction,
16 renovation, landscaping and maintenance of armories, hangars, and other
17 properties held for the use and benefit of the Arkansas National Guard, in a
18 sum not to exceed ................................................$1,849,784.

20      SECTION 3. DISBURSEMENT CONTROLS. (A)   No contract may be awarded nor
21 obligations otherwise incurred in relation to the project or projects
22 described herein in excess of the State Treasury funds actually available
23 therefor as provided by law.   Provided, however, that institutions and
24 agencies listed herein shall have the authority to accept and use grants and
25 donations including Federal funds, and to use its unobligated cash income or
26 funds, or both available to it, for the purpose of supplementing the State
27 Treasury funds for financing the entire costs of the project or projects
28 enumerated herein.   Provided further, that the appropriations and funds
29 otherwise provided by the General Assembly for Maintenance and General
30 Operations of the agency or institutions receiving appropriation herein shall
31 not be used for any of the purposes as appropriated in this act.
32      (B) The restrictions of any applicable provisions of the State
33 Purchasing Law, the General Accounting and Budgetary Procedures Law, the
34 Revenue Stabilization Law and any other applicable fiscal control laws of
35 this State and regulations promulgated by the Department of Finance and
36 Administration, as authorized by law, shall be strictly complied with in

1 disbursement of any funds provided by this act unless specifically provided
2 otherwise by law.

4      SECTION 4. LEGISLATIVE INTENT.   It is the intent of the General
5 Assembly that any funds disbursed under the authority of the appropriations
6 contained in this act shall be in compliance with the stated reasons for
7 which this act was adopted, as evidenced by the Agency Requests, Executive
8 Recommendations and Legislative Recommendations contained in the budget
9 manuals prepared by the Department of Finance and Administration, letters, or
10 summarized oral testimony in the official minutes of the Arkansas Legislative
11 Council or Joint Budget Committee which relate to its passage and adoption.

13      SECTION 5. EMERGENCY CLAUSE.   It is found and determined by the General
14 Assembly, that the Constitution of the State of Arkansas prohibits the
15 appropriation of funds for more than a one (1) year period; that the
16 effectiveness of this Act on July 1, 2026 is essential to the operation of
17 the agency for which the appropriations in this Act are provided, and that in
18 the event of an extension of the legislative session, the delay in the
19 effective date of this Act beyond July 1, 2026 could work irreparable harm
20 upon the proper administration and provision of essential governmental
21 programs. Therefore, an emergency is hereby declared to exist and this Act
22 being necessary for the immediate preservation of the public peace, health
23 and safety shall be in full force and effect from and after July 1, 2026.
