REAPPROPRIATION - ADE - DIVISION OF HIGHER EDUCATION -24 NORTHWEST TECHNICAL INSTITUTE - DEVELOPMENT AND ENHANCEMENT. There is hereby25 appropriated, to the Department of Education, to be payable from the26 Development and Enhancement Fund, for the Department of Education - Division27 of Higher Education - Northwest Technical Institute the following:28(A) Effective July 1, 2026, the balance of the appropriation provided29 in Item (A) of Section 1 of Act 337 of 2025, for transfers of or refund to30 expenditures for balances for construction, renovation, major maintenance,31 and purchase of equipment for various capital projects or facility32 improvements, in a sum not to exceed .............................$1,000,000.33(B) Effective July 1, 2026, the balance of the appropriation provided34 in Item (A) of Section 1 of Act 73 of 2025, for transfers of or refund to35 expenditures for balances for construction, renovation, major maintenance,36 and purchase of equipment for various capital projects or facility*KMW077* 04/14/2026 2:08:14 PM KMW077HB10841 improvements, in a sum not to exceed ...............................$448,902.2 (C) Effective July 1, 2026, the balance of the appropriation provided3 in Item (B) of Section 1 of Act 73 of 2025, for transfers of or refund to4 expenditures for capital balances for construction, renovation, major5 maintenance, and purchase of equipment for various capital projects or6 facility improvements, in a sum not to exceed .......................$10,134.7 (D) Effective July 1, 2026, the balance of the appropriation provided8 in Item (C) of Section 1 of Act 73 of 2025, for Industrial Technology Center9 construction, parking, equipment, and furnishings costs, in a sum not to10 exceed ..............................................................$36,307.1112 SECTION 2. DISBURSEMENT CONTROLS. (A) No contract may be awarded nor13 obligations otherwise incurred in relation to the project or projects14 described herein in excess of the State Treasury funds actually available15 therefor as provided by law. Provided, however, that institutions and16 agencies listed herein shall have the authority to accept and use grants and17 donations including Federal funds, and to use its unobligated cash income or18 funds, or both available to it, for the purpose of supplementing the State19 Treasury funds for financing the entire costs of the project or projects20 enumerated herein. Provided further, that the appropriations and funds21 otherwise provided by the General Assembly for Maintenance and General22 Operations of the agency or institutions receiving appropriation herein shall23 not be used for any of the purposes as appropriated in this act.24 (B) The restrictions of any applicable provisions of the State25 Purchasing Law, the General Accounting and Budgetary Procedures Law, the26 Revenue Stabilization Law and any other applicable fiscal control laws of27 this State and regulations promulgated by the Department of Finance and28 Administration, as authorized by law, shall be strictly complied with in29 disbursement of any funds provided by this act unless specifically provided30 otherwise by law.3132 SECTION 3. LEGISLATIVE INTENT. It is the intent of the General33 Assembly that any funds disbursed under the authority of the appropriations34 contained in this act shall be in compliance with the stated reasons for35 which this act was adopted, as evidenced by the Agency Requests, Executive36 Recommendations and Legislative Recommendations contained in the budget204/14/2026 2:08:14 PM KMW077HB10841 manuals prepared by the Department of Finance and Administration, letters, or2 summarized oral testimony in the official minutes of the Arkansas Legislative3 Council or Joint Budget Committee which relate to its passage and adoption.45 SECTION 4. EMERGENCY CLAUSE. It is found and determined by the General6 Assembly, that the Constitution of the State of Arkansas prohibits the7 appropriation of funds for more than a one (1) year period; that the8 effectiveness of this Act on July 1, 2026 is essential to the operation of9 the agency for which the appropriations in this Act are provided, and that in10 the event of an extension of the legislative session, the delay in the11 effective date of this Act beyond July 1, 2026 could work irreparable harm12 upon the proper administration and provision of essential governmental13 programs.
