REAPPROPRIATION - ADE - ARKANSAS SCHOOL FOR THE DEAF AND24 BLIND - DEVELOPMENT AND ENHANCEMENT. There is hereby appropriated, to the25 Department of Education, to be payable from the Development and Enhancement26 Fund, for the Department of Education - Arkansas School for the Deaf and27 Blind the following:28(A) Effective July 1, 2026, the balance of the appropriation provided29 in Item (A) of Section 1 and Item (A) of Section 2 of Act 81 of 2025, for30 various maintenance, renovation, equipping, construction, acquisition,31 improvement, upgrade, and repair of real property and facilities at the32 Arkansas School for the Deaf and Blind campus, in a sum not to33 exceed...........................................................$20,750,936.34(B) Effective July 1, 2026, the balance of the appropriation provided35 in Item (A) of Section 1 of Act 332 of 2025, for various maintenance,36 renovation, equipping, construction, acquisition, improvement, upgrade, and*KMW078* 04/14/2026 2:09:54 PM KMW078HB10851 repair of real property and facilities, in a sum not to exceed...$35,000,000.23 SECTION 2. REAPPROPRIATION - ADE - ARKANSAS SCHOOL FOR THE DEAF AND4 BLIND - NCRC GRANT. There is hereby appropriated, to the Department of5 Education, to be payable from the Arkansas Natural and Cultural Resources6 Grant and Trust Fund, for the Department of Education - Arkansas School for7 the Deaf and Blind the following:8 (A) Effective July 1, 2026, the balance of the appropriation provided9 in Section 24 of Act 297 of 2025, for the acquisition, management,10 stewardship, or preservation of state owned lands, historic sites, buildings,11 structures, or objects, in a sum not to exceed ...................$1,118,000.1213 SECTION 3. DISBURSEMENT CONTROLS. (A) No contract may be awarded nor14 obligations otherwise incurred in relation to the project or projects15 described herein in excess of the State Treasury funds actually available16 therefor as provided by law. Provided, however, that institutions and17 agencies listed herein shall have the authority to accept and use grants and18 donations including Federal funds, and to use its unobligated cash income or19 funds, or both available to it, for the purpose of supplementing the State20 Treasury funds for financing the entire costs of the project or projects21 enumerated herein. Provided further, that the appropriations and funds22 otherwise provided by the General Assembly for Maintenance and General23 Operations of the agency or institutions receiving appropriation herein shall24 not be used for any of the purposes as appropriated in this act.25 (B) The restrictions of any applicable provisions of the State26 Purchasing Law, the General Accounting and Budgetary Procedures Law, the27 Revenue Stabilization Law and any other applicable fiscal control laws of28 this State and regulations promulgated by the Department of Finance and29 Administration, as authorized by law, shall be strictly complied with in30 disbursement of any funds provided by this act unless specifically provided31 otherwise by law.3233 SECTION 4. LEGISLATIVE INTENT. It is the intent of the General34 Assembly that any funds disbursed under the authority of the appropriations35 contained in this act shall be in compliance with the stated reasons for36 which this act was adopted, as evidenced by the Agency Requests, Executive204/14/2026 2:09:54 PM KMW078HB10851 Recommendations and Legislative Recommendations contained in the budget2 manuals prepared by the Department of Finance and Administration, letters, or3 summarized oral testimony in the official minutes of the Arkansas Legislative4 Council or Joint Budget Committee which relate to its passage and adoption.56 SECTION 5. EMERGENCY CLAUSE. It is found and determined by the General7 Assembly, that the Constitution of the State of Arkansas prohibits the8 appropriation of funds for more than a one (1) year period; that the9 effectiveness of this Act on July 1, 2026 is essential to the operation of10 the agency for which the appropriations in this Act are provided, and that in11 the event of an extension of the legislative session, the delay in the12 effective date of this Act beyond July 1, 2026 could work irreparable harm13 upon the proper administration and provision of essential governmental14 programs.
