[473.686] IMMIGRANT DETENTION FLIGHTS.1.7Subdivision 1. Definitions. (a) For purposes of this section, the following terms have1.8 the meanings given.1.9(b) "Commission" means the Metropolitan Airports Commission established under1.10 section 473.603.1.11(c) "Detained individual" means an aircraft passenger who is traveling involuntarily or1.12 being held in any kind of restraint other than a seatbelt.1.13(d) "ICE Air" means the U.S. Immigration and Customs Enforcement Air Operations1.14 division that facilitates the transfer and removal of undocumented immigrants on commercial1.15 airlines and chartered flights.1.16(e) "MSP" means the Minneapolis-St. Paul International Airport.1.17(f) "Signature Aviation" means the entity that operates the Signature Aviation terminal.1.18(g) "Signature Aviation terminal" means the terminal at MSP operated by Signature1.19 Aviation that accommodates private international and business flights.Section 1. 103/24/26 REVISOR KRB/DG 26-08230 as introduced2.1 Subd. 2. Notice required. Signature Aviation must notify the commission of each flight2.2 chartered by ICE Air that arrives at or departs from the Signature Aviation terminal. Each2.3 notification must include:2.4 (1) the number of passengers who are detained individuals;2.5 (2) the number of detained individuals who are under 18 years of age;2.6 (3) the scheduled arrival and departure times; and2.7 (4) the origin and destination.2.8 Subd. 3. Streaming video. (a) The commission must install, maintain, and operate a2.9 camera capable of recording and streaming footage live on the Internet 24 hours per day.2.10 The camera must be installed in a location that allows for recording and streaming footage2.11 of the loading and unloading of all passengers on flights chartered by ICE Air at the Signature2.12 Aviation terminal. The livestream footage must be accessible to the public on the2.13 commission's website.2.14 (b) Upon receiving notification under subdivision 2, commission staff must monitor the2.15 loading and unloading of each flight chartered by ICE Air arriving at and departing from2.16 the Signature Aviation terminal. Commission staff must record the number of passengers,2.17 including detained individuals, who are loaded and unloaded for purposes of preparing the2.18 monthly report required under subdivision 4.2.19 Subd. 4. Monthly report. On the 15th of each month, the commission must submit a2.20 report to the chairs and ranking minority members of the legislative committees with2.21 jurisdiction over public safety and state government. The report must include the following2.22 information about each flight chartered by ICE Air:2.23 (1) the number of flights arriving at and departing from the Signature Aviation terminal,2.24 including the origin and destination; and2.25 (2) the number of detained individuals loaded or unloaded, including the number of2.26 detained individuals who are under 18 years of age.2.27 EFFECTIVE DATE. This section is effective the day following final enactment.Section 1. 2
