HOUSE CONCURRENT RESOLUTION NO. 85
BY REPRESENTATIVE KNOX
  A CONCURRENT RESOLUTION
To create the Task Force on Illegal Dumping Prevention and Enforcement to study the
        extent of illegal dumping of waste and enforcement mechanisms and to report its
        findings to certain enumerated House and Senate committees.
        WHEREAS, illegal dumping is a problem facing Louisianans in recent times; and
        WHEREAS, illegal dumping often involves operations of people transporting waste
materials across parish lines to dump or dumping waste on the sides of highways and
roadways; and
        WHEREAS, dumping hot spots have detrimental impacts on the environment and
are known to attract mosquitoes and other pests; and
        WHEREAS, Louisiana needs to find solutions to the illegal dumping problems
whether at the state or local level.
        THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby
establish and provide for the Task Force on Illegal Dumping Prevention and Enforcement
to study the extent of illegal dumping and enforcement mechanisms, and may propose
recommendations, together with specific proposals for legislation.
        BE IT FURTHER RESOLVED that the legislature recommends that the task force
include consideration of the extent of illegal dumping and enforcement mechanisms.
        BE IT FURTHER RESOLVED that the task force shall consist of the following
members:
        (1) One representative from the Department of Environmental Quality appointed by
the secretary.
        (2) One representative from the Senate appointed by the president of the Senate.

  (3) One representative from the House of Representatives appointed by the speaker
of the House of Representatives.
  (4) One representative from the Department of Transportation and Development
appointed by the secretary.
  (5) One representative from the Department of Wildlife and Fisheries appointed by
the secretary.
  (6) One representative from the New Orleans Mosquito, Termite and Rodent Control
Board appointed by the director.
  (7) One representative from the Orleans Parish District Attorney's Office appointed
by the district attorney.
  (8)    One representative from the Louisiana State Police appointed by the
superintendent.
  (9) One representative from the Louisiana Sheriff's Association appointed by the
president.
  (10) One representative from the New Orleans Department of Sanitation appointed
by the mayor.
  (11) One representative from the Louisiana Municipal Association appointed by the
executive board.
  (12) One representative from Healthy Gulf appointed by the executive director.
  (13) One representative from a community based environmental justice organization
appointed by joint decision of the speaker of the House of Representatives and the president
of the Senate.
  (14) One representative from the recycling or waste management industry appointed
by joint decision of the speaker of the House of Representatives and the president of the
Senate.
  (15) One representative from Keep Louisiana Beautiful appointed by the lieutenant
governor.
  (16) One representative from the Police Jury Association of Louisiana appointed by
the executive director.

       BE IT FURTHER RESOLVED that each appointing authority shall submit the names
of appointees to the task force to the Department of Environmental Quality, the Department
of Transportation and Development, and the Department of Wildlife and Fisheries, no later
than August 1, 2026.
       BE IT FURTHER RESOLVED the task force shall be chaired by the appointee from
the Department of Environmental Quality.
       BE IT FURTHER RESOLVED that the task force shall convene for its first meeting
no later than September 1, 2026.
       BE IT FURTHER RESOLVED that the task force shall be staffed by the Department
of Environmental Quality.
       BE IT FURTHER RESOLVED that a majority of the task force shall constitute a
quorum for the transaction of business and all official actions of the task force shall require
the affirmative vote of a majority of the members.
       BE IT FURTHER RESOLVED that the Rules of Order of the House of
Representatives or applicable Joint Rules shall apply to all meetings of the task force.
       BE IT FURTHER RESOLVED that the members of the task force shall serve
without compensation, except per diem or expense reimbursement to which they may be
individually entitled as members of their constituent organizations.
       BE IT FURTHER RESOLVED that meetings of the task force shall be subject to the
Open Meetings Law, R.S. 42:11 et seq., and records of the task force shall be subject to the
Public Records Law, R.S. 44:1 et seq.
       BE IT FURTHER RESOLVED that the task force shall submit a written report
detailing its findings to the House Committee on Natural Resources and Environment, the
House Committee on Transportation, Highways and Public Works, the Senate Committee
on Environmental Quality, and the Senate Committee on Transportation, Highways and
Public Works no later than thirty days prior to the convening of the 2027 Regular Session
of the Legislature.
       BE IT FURTHER RESOLVED that any written recommendations or proposals shall
also be submitted and to the David R. Poynter Legislative Research Library as required by
R.S. 24:771 and 772.

       BE IT FURTHER RESOLVED that the task force shall terminate following the
conclusion of its business or by February 12, 2027, whichever occurs first.
       BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
secretary of the Department of Environmental Quality, the secretary of the Department of
Transportation and Development, the secretary of the Department of Wildlife and Fisheries,
the director of the New Orleans Mosquito, Termite and Rodent Control Board, the district
attorney for the Orleans Parish District Attorney's Office, the superintendent of the Louisiana
State Police, the president of the Sheriff's Association, the mayor of New Orleans on behalf
of the New Orleans Department of Sanitation, the president of the Louisiana Municipal
Association, the executive director of Healthy Gulf, the lieutenant governor, and the
executive director of the Police Jury Association of Louisiana.
