hf2787/enrolled.txtHouseFile2787-EnrolledHouseFile2787ANACTPROHIBITINGWARRANTRESOLUTIONCLINICS,INCLUDINGENFORCEMENTMECHANISMS,PROVIDINGPENALTIES,ANDINCLUDINGEFFECTIVEDATEPROVISIONS.BEITENACTEDBYTHEGENERALASSEMBLYOFTHESTATEOFIOWA:Section1.NEWSECTION.804.32Warrantresolutionclinicsprohibited.1.Asusedinthissection,“warrantresolutionclinic”meansaprearranged,formalorinformal,advertisedeventdesignedtoallowindividualswithoutstandingarrestwarrantstoappearandresolvesuchwarrantswithoutbeingsubjecttoimmediatearrestandcustodialprocessing.2.Anentity,organization,countyattorney,lawenforcementagency,judicialofficer,nonprofitorganization,oranyotherpersonshallnotorganize,sponsor,host,fund,promote,orparticipateinawarrantresolutionclinic.HouseFile2787,p.23.Apersonwhohasanoutstandingwarrantfortheperson’sarrestshallonlyresolvesuchwarrantbyanyofthefollowing:a.Surrenderingtoapeaceofficeroratalawenforcementagency.b.Appearingatascheduledcourthearingasdirectedbyamagistrateorjudgeunderstandardjudicialprocedures.c.Throughawrittenororalmotionmadeinanindividual,pendingcase,withnoticeprovidedtotheprosecutingattorney,andruledonbythecourtunderstandardjudicialproceduresintheordinarycourseofthecase,andnotaspartofanyevent,program,orarrangementprohibitedbythissection.4.Theuseofpublicfundsorfacilitiesforthepurposeofhostingawarrantresolutionclinicisstrictlyprohibited.5.Apersonshallnotevadeorattempttoevadetheprohibitionsofthissectionbyconductingasubstantiallyequivalentprogram,event,orarrangementunderadifferentname,structure,ordesignation.Aprogram,event,orarrangementissubstantiallyequivalentifitsprimarypurposeorpracticaleffectistoallowindividualswithoutstandingarrestwarrantstoappearandresolvethosewarrantswithoutbeingsubjecttoimmediatearrestandcustodialprocessing.Evidencethataprogramissubstantiallyequivalentincludesbutisnotlimitedto:a.Block-schedulingorclusteringwarrantcasesonasingledocketdaywithanexplicitorimplicitunderstandingthatattendingindividualswillnotbesubjecttoimmediatearrest.b.Advertisingorcommunicatingtoindividualswithoutstandingwarrantsthattheymayappearataparticulartimeandplacetoresolvewarrantswithoutriskofarrest.c.Coordinatingbetweenlawenforcement,courtpersonnel,attorneys,orcommunityorganizationstofacilitatenoncustodialwarrantresolutionoutsideofstandardjudicialprocedures.6.Aviolationofthissectionissubjecttothefollowingpenalties:a.(1)Apublicofficialoremployeewhoknowinglyviolatesthissectioncommitsasimplemisdemeanor.(2)Inadditiontothepenaltyprovidedinsubparagraph(1),apublicofficialoremployeewhoknowinglyviolatesthisHouseFile2787,p.3sectionisalsosubjecttoremovalfromofficeoremploymentpursuanttoapplicablelaw.b.Aprivatepersonthatknowinglyorganizes,sponsors,hosts,orfundsawarrantresolutionclinicorsubstantiallyequivalentprograminviolationofthissectioncommitsasimplemisdemeanorandisalsosubjecttoacivilpenaltyofnotmorethantenthousanddollarsperviolation,recoverablebytheattorneygeneralinanactionindistrictcourt.7.Anypersonmayreportasuspectedviolationofthissectiontotheofficeoftheattorneygeneral.Uponreceiptofareportorupontheattorneygeneral’sowninitiative,theattorneygeneralmayinvestigatesuspectedviolationsandmaybringacivilenforcementactionindistrictcourtseekinginjunctiverelief,civilpenaltiesasprovidedinsubsection6,andrecoveryofcostsandreasonableattorneyfees.Theattorneygeneralshallestablishaprocedureforreceivingandreviewingreportsunderthissubsectionandshallmakesuchprocedurepubliclyavailable.8.Anyresidentofacountyinwhichawarrantresolutionclinicorsubstantiallyequivalentprogramisconductedorplannedinviolationofthissectionmaybringacivilactionindistrictcourttodoanyofthefollowing:a.Obtaininjunctiveordeclaratoryrelieftopreventorrestraintheviolation.b.Recoveractualdamages,ifany.c.Recoverreasonableattorneyfeesandcourtcostsiftheplaintiffsubstantiallyprevails.9.Inadditiontoanyotherpenalty,anycountyorganizing,sponsoring,hosting,funding,promoting,orparticipatinginawarrantresolutionclinicshallnotreceiveanyfundshavingtheiroriginincourtdebt,asdefinedinsection602.8107,includingbutnotlimitedtofeesorremittancesarisingfromorrelatedtothecollectionofpastduefinesandfeesconstitutingcourtdebt.10.Thissectionpreemptsandsupersedesanyordinance,resolution,policy,rule,orotheractionbyacity,county,orotherpoliticalsubdivisionofthisstatethatauthorizes,permits,funds,orfacilitatesawarrantresolutionclinicoranysubstantiallyequivalentprogram,event,orarrangementasHouseFile2787,p.4describedinthissection.Nopoliticalsubdivisionofthisstateshallenactorenforceanyprovisionthatconflictswithorpurportstoauthorizeconductprohibitedbythissection.Sec.2.EFFECTIVEDATE.ThisAct,beingdeemedofimmediateimportance,takeseffectuponenactment.______________________________PATGRASSLEYSpeakeroftheHouse______________________________AMYSINCLAIRPresidentoftheSenateIherebycertifythatthisbilloriginatedintheHouseandisknownasHouseFile2787,Ninety-firstGeneralAssembly.______________________________MEGHANNELSONChiefClerkoftheHouseApproved_______________,2026______________________________KIMREYNOLDSGovernor
