hf2788/enrolled.txtHouseFile2788-EnrolledHouseFile2788ANACTRELATINGTOABORTIONSINCLUDINGDEFINITIONS,INFORMEDCONSENT,DISPENSINGOFABORTION-INDUCINGDRUGS,ANDOTHERABORTION-RELATEDPROVISIONS.BEITENACTEDBYTHEGENERALASSEMBLYOFTHESTATEOFIOWA:DIVISIONIABORTION——DEFINEDSection1.Section146B.1,subsection1,Code2026,isamendedtoreadasfollows:1.“Abortion”meanstheterminationofahumanpregnancywiththeintentotherthantoproducealivebirthortoremoveadeadfetus.“Abortion”doesnotincludeanyofthefollowing:a.Treatmentofaspontaneousterminationofpregnancy,commonlyknownasamiscarriage.b.Removaloftheproductsofconceptionafteranincompleteorinevitablelossofapregnancy.c.Treatmentofanectopicpregnancy.Sec.2.Section146E.1,subsection1,Code2026,isamendedtoreadasfollows:1.“Abortion”meanstheterminationofahumanpregnancywiththeintentotherthantoproducealivebirthortoremoveadeadfetussameasdefinedinsection146B.1.HouseFile2788,p.2DIVISIONIIINFORMEDCONSENTSec.3.Section146A.1,Code2026,isamendedbyaddingthefollowingnewsubsection:NEWSUBSECTION.1A.Priortoperforminganabortion,aphysicianshallperformanin-personexaminationofthepregnantwomanincludingscreeningforindiciaofcoercionorabuse.Aphysicianshall,ifnecessary,referthewomantoanappropriatehealthcareproviderfortreatmentconsistentwiththeexaminationresults.Sec.4.Section146A.1,subsection6,Code2026,isamendedbyaddingthefollowingnewparagraphs:NEWPARAGRAPH.0a.“Abortion”meansthesameasdefinedinsection146B.1.NEWPARAGRAPH.00a.“Healthcareprovider”meansapersonwhoislicensed,certified,orotherwiseauthorizedorpermittedbythelawsofthisstatetoadministerhealthcareintheordinarycourseofbusinessorinthepracticeofaprofession.NEWPARAGRAPH.0b.“Physician”meansthesameasdefinedinsection146B.1.Sec.5.NEWSECTION.146A.2Prerequisitesfordispensingabortion-inducingdrugs——licenseediscipline.1.Asusedinthissection,unlessthecontextotherwiserequires:a.“Abortion-inducingdrug”meansthesameasdefinedinsection146F.1.b.“Chemicalabortion”meansthesameasdefinedinsection146F.1.c.“Dispense”meansthesameasdefinedinsection146F.1.d.“Medicalemergency”meansthesameasdefinedinsection146A.1.e.“Pregnant”or“pregnancy”meansthehumanfemalereproductiveconditionofhavingalivingunbornchildwithinthepregnantwoman’sbodythroughouteverystageoftheunbornchild’slifeanddevelopment,fromfertilizationtofullgestationandchildbirth.2.AphysicianwhoisperformingorattemptingtoperformachemicalabortionshalldoallofthefollowingpriortoHouseFile2788,p.3prescribingordispensinganabortion-inducingdrugtoapregnantwoman:a.ObtainthesignatureofthewomanontheUnitedStatesfoodanddrugadministrationpatientagreementformrequiredforeachabortion-inducingdrugauthorizedtobemanufacturedorsoldintheUnitedStates.b.Obtainwrittenconfirmationfromthewomanthatthewomanhasbeeninformedofallofthefollowinginformation:(1)Thegestationalage-specificrisksofabortion-inducingdrugs.(2)Therisksrelatedtothespecificabortion-inducingdrugordrugstobeused,includinghemorrhage,failuretoremovealltissueoftheunbornchild,sepsis,sterility,andpossiblecontinuationofthepregnancy.(3)ThattheUnitedStatesfederalfoodanddrugadministrationrecommendsthatthepregnantwomanfollowupwiththewoman’shealthcareproviderapproximatelyseventofourteencalendardaysaftertheadministrationofanabortion-inducingdrugtoconfirmcompleteterminationofpregnancyhasoccurredandtoevaluatethedegreeofbleeding.(4)Thatwomenusingabortion-inducingdrugshavesufferedtraumafromseeingtheremainsoftheunbornchildintheprocessofachemicalabortion.c.Advisethepregnantwomanhowtoaccessemergencysurgicalinterventionincaseofanincompleteabortion,severebleeding,orothermedicalcomplications.3.Subsection2shallnotapplytoachemicalabortionperformedinresponsetoamedicalemergency.4.Thissectionshallnotbeconstruedtoimposecivilorcriminalliabilityonawomanuponwhomachemicalabortionhasbeenperformed.5.Aphysicianwhofailstocomplywiththissectionissubjecttolicenseedisciplineunderchapter148.6.Theboardofmedicineshalladoptrulespursuanttochapter17Atoadministerthissection.DIVISIONIIIDISPENSINGABORTION-INDUCINGDRUGSSec.6.NEWSECTION.146F.1Definitions.Asusedinthischapter,unlessthecontextotherwiseHouseFile2788,p.4requires:1.“Abortion-inducingdrug”meansanydrug,chemical,orothersubstancethatisprescribedoradministeredwiththeintentofperforminganabortion.“Abortion-inducingdrug”doesnotincludeadrug,chemical,orothersubstancethatisprescribedoradministeredforapurposeotherthantoperformanabortion,evenifthedrugmaybeknowntocauseanabortion.2.“Chemicalabortion”meansanabortionperformedbytheadministrationoruseofanabortion-inducingdrug.3.“Dispense”meanstodistribute,administer,orsendanabortion-inducingdrugtotheultimateuser.4.“Healthcaresetting”meansapharmacy,clinic,medicaloffice,orhospital.5.“Hospital”meansthesameasdefinedinsection135B.1.6.“Interestedparty”meansanyofthefollowingpersons:a.Awomanuponwhomachemicalabortionwasperformedorattempted.b.Thepersonalrepresentativeofawomanuponwhomachemicalabortionwasperformedorattempted.7.“Medicalemergency”meansthesameasdefinedinsection146A.1.8.“Personalrepresentative”meansanadministratororanexecutor,orifthereisnosuchpersonalrepresentativeappointed,the
