1.1A bill for an act
1.2relating to cemeteries; requiring public cemeteries to allow individuals to be buried
1.3in accordance with their recognized religion; requiring public cemeteries to allow
1.4green burials; amending Minnesota Statutes 2025 Supplement, section 306.991,
1.5subdivisions 2, 6; proposing coding for new law in Minnesota Statutes, chapter
1.6306.
1.7      BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.8Section 1. [306.98] BURIAL; RITES OF RECOGNIZED RELIGION.
1.9(a) For purposes of this section, "green burial" has the meaning given in section 149A.02,
1.10     subdivision 42.
1.11(b) A municipality, town, or other cemetery governed by this chapter must permit an
1.12     individual to be buried in accordance with the rites of the individual's recognized religion,
1.13     including but not limited to permitting an individual to be buried by green burial, if the
1.14     burial is performed in compliance with chapter 149A and, for green burials, in compliance
1.15     with chapter 149A and section 306.991.
1.16Sec. 2. Minnesota Statutes 2025 Supplement, section 306.991, subdivision 2, is amended
1.17     to read:
1.18Subd. 2. Green burial requirements. A municipality, town, or other cemetery governed
1.19     by this chapter that allows for must allow green burials. A green burial must comply with
1.20     the requirements of this section.

2.1   Sec. 3. Minnesota Statutes 2025 Supplement, section 306.991, subdivision 6, is amended
2.2 to read:
2.3     Subd. 6. Burial density. (a) Except as provided in paragraph (b), green burial plots must
2.4 be a maximum of 300 burials per acre over a 100-year period.
2.5     (b) A municipality, town, or other cemetery governed by this chapter must permit green
2.6 burials at a greater density than the density specified in paragraph (a) for green burials of
2.7 individuals for whom green burial is an element of the burial rites of the individual's
2.8 recognized religion.
