1.2relating to pipelines; prohibiting the issuance of a route permit for certain carbon
1.3dioxide pipelines; amending Minnesota Statutes 2024, section 216G.025,
1.4subdivisions 1, 2.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6Section 1. Minnesota Statutes 2024, section 216G.025, subdivision 1, is amended to read:
1.7Subdivision 1. Definitions. (a) For the purposes of this section, the following terms have
1.8the meanings given.
1.9(b) "Carbon dioxide pipeline" means a pipeline located in Minnesota that transports
1.10carbon dioxide in a liquid, gaseous, or supercritical state.
1.11(c) "Commission" means the Public Utilities Commission.
1.12(d) "Public waters" has the meaning given in section 103G.005, subdivision 15.
1.13(d) (e) "Supercritical" means a physical state in which a substance is more dense than a
1.14gas but less dense than a liquid.
1.15EFFECTIVE DATE. This section is effective the day following final enactment.
1.16Sec. 2. Minnesota Statutes 2024, section 216G.025, subdivision 2, is amended to read:
1.17Subd. 2. Routing permit required; prohibitions. (a) A person is prohibited from
1.18constructing or operating a carbon dioxide pipeline without a route permit issued by the
1.19commission under this chapter.

2.1     (b) A person seeking to construct or operate a carbon dioxide pipeline is prohibited from
2.2 applying to the commission for a conditional exclusion or partial exemption from pipeline
2.3 route selection procedures under Minnesota Rules, chapter 7852.
2.4     (c) The commission is prohibited from issuing a permit to construct a carbon dioxide
2.5 pipeline that:
2.6     (1) exceeds 1,000 feet in length in Minnesota; or
2.7     (2) travels over, under, or through public waters.
2.8     EFFECTIVE DATE. This section is effective the day following final enactment.
