WARD, MAY 28, 2026SENATOR STEFANO, CONSUMER PROTECTION AND PROFESSIONAL LICENSURE,AS AMENDED, JUNE 3, 2026AN ACT1 Amending the act of December 22, 1983 (P.L.306, No.84), entitled2 "An act providing for the State Board of Vehicle3 Manufacturers, Dealers and Salespersons; and providing4 penalties," IN PRELIMINARY PROVISIONS, FURTHER PROVIDING FOR <--5 DEFINITIONS; AND, in vehicles, further providing for unlawful6 acts by manufacturers or distributors., FOR AREA OF <--7 RESPONSIBILITY AND FOR LIMITATIONS ON ESTABLISHING OR8 RELOCATING DEALERS.9 The General Assembly of the Commonwealth of Pennsylvania10 hereby enacts as follows:11 Section 1. Section 310(d) of the act of December 22, 1983 <--12 (P.L.306, No.84), known as the Board of Vehicles Act, is amended13 by adding a paragraph to read:14 SECTION 1. THE DEFINITION OF "RELEVANT MARKET AREA" IN <--15 SECTION 102 OF THE ACT OF DECEMBER 22, 1983 (P.L.306, NO.84),16 KNOWN AS THE BOARD OF VEHICLES ACT, IS AMENDED TO READ:17 SECTION 102. DEFINITIONS.18 THE FOLLOWING WORDS AND PHRASES WHEN USED IN THIS ACT SHALL19 HAVE THE MEANINGS GIVEN TO THEM IN THIS SECTION UNLESS THE20 CONTEXT CLEARLY INDICATES OTHERWISE:21 * * *1 "RELEVANT MARKET AREA." THE AREA WITHIN A RADIUS OF 20 MILES2 AROUND AN EXISTING DEALER OR THE AREA OF RESPONSIBILITY DEFINED3 IN THE FRANCHISE, WHICHEVER IS GREATER; EXCEPT:4(1) WHERE A MANUFACTURER IS SEEKING TO ESTABLISH AN5 ADDITIONAL NEW VEHICLE DEALER, THE RELEVANT MARKET AREA SHALL6 BE IN ALL INSTANCES THE AREA WITHIN A RADIUS OF TEN MILES7 AROUND THE PROPOSED SITE OF THE ADDITIONAL NEW VEHICLE8 DEALER, EXCEPT FOR CITIES OF THE FIRST AND SECOND CLASS WHICH9 WILL BE THE AREA WITHIN A FIVE-MILE RADIUS, AROUND THE10 PROPOSED SITE OF THE ADDITIONAL NEW VEHICLE DEALER; AND11(2) WHERE A MANUFACTURER IS SEEKING TO RELOCATE AN12 EXISTING DEALER, THE RELEVANT MARKET AREA IS THE AREA WITHIN13 A RADIUS OF 20 MILES AROUND THE PROPOSED SITE OF THE14 RELOCATING DEALER OR THE AREA OF RESPONSIBILITY DEFINED IN15 THE FRANCHISE OF THE RELOCATING DEALER, WHICHEVER IS GREATER.16 THIS DEFINITION SHALL NOT APPLY TO MANUFACTURED HOUSING [OR]17 DEALERS, RECREATIONAL VEHICLE DEALERS OR DEALERS OF TRAILERS, OR18 THEIR MANUFACTURER AGREEMENTS.19 * * *20 SECTION 2. SECTION 310(D) OF THE ACT IS AMENDED BY ADDING A21 PARAGRAPH TO READ:22 Section 310. Unlawful acts by manufacturers or distributors.23 * * *24 (d) Applicability.--25* * *26(1.2) This section shall not apply to manufacturers,27 distributors or dealers of trailers.28* * *29 Section 2.
