                               AN ACT
1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
2    act to consolidate, editorially revise, and codify the public
3    welfare laws of the Commonwealth," in departmental powers and
4    duties as to licensing, providing for issuance of licenses by
5    Department of Drug and Alcohol Programs.
6    The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8    Section 1.    The act of June 13, 1967 (P.L.31, No.21), known
9 as the Human Services Code, is amended by adding a section to
10 read:
11    Section 1027.    Issuance of Licenses by Department of Drug and
12 Alcohol Programs.--(a)    Notwithstanding section 1009, the
13 Department of Drug and Alcohol Programs shall issue to a
14 provider a license for a term of two years if the Department of
15 Drug and Alcohol Programs determines that the provider meets the
16 following conditions:
17    (1)   The provider's license is in good standing and has not
18 been in provisional status for at least two consecutive years.
19    (2)   The provider has received a current multiyear
1 accreditation from a national accreditation organization. The
2 Department of Drug and Alcohol Programs shall accept a final
3 accreditation report from the accrediting body, or a true copy
4 thereof furnished by the provider, as evidence that the provider
5 meets the applicable licensure requirements.
6    (3)   The process for the accreditation includes a review to
7 determine whether the provider's programs and services meet
8 defined standards of quality in health and human services and is
9 maintained through ongoing conformance and review, including a
10 survey at the end of the accreditation period to determine
11 whether accreditation should continue.
12    (4)   The provider agrees that if the provider fails to
13 maintain the accreditation, the provider will notify the
14 Department of Drug and Alcohol Programs no later than fourteen
15 days after the lapse in accreditation. If the provider fails to
16 provide the notice as required by this paragraph, the provider
17 shall be subject to standard licensure requirements, including
18 inspection and issuance of a one-year license at the next
19 renewal or earlier action as provided by law.
20    (b)   If the Department of Drug and Alcohol Programs issues a
21 two-year license to a provider under this section, the
22 Department of Drug and Alcohol Programs shall conduct a single
23 licensing inspection of the provider for each two-year licensing
24 period. The following apply to an inspection under this
25 subsection:
26    (1)   The inspection shall constitute the required licensure
27 inspection for that period and may not be conducted as separate
28 annual inspections.
29    (2)   The scope and depth of the inspection shall be
30 equivalent to that of a standard one-year licensing inspection

1 and may not be expanded on the basis that the inspection covers
2 a two-year period.
3    (3)   The Department of Drug and Alcohol Programs may utilize
4 representative sampling of policies, procedures and patient
5 records from the licensing period in conducting the inspection.
6    (c)   Nothing in this section shall be construed to limit the
7 authority of the Department of Drug and Alcohol Programs to
8 conduct inspections in response to complaints or other reports
9 made to the Department of Drug and Alcohol Programs.
10    Section 2.   This act shall take effect in 60 days.
