The act of June 13, 1967 (P.L.31, No.21), known9 as the Human Services Code, is amended by adding a section to10 read:11 Section 1027. Issuance of Licenses by Department of Drug and12 Alcohol Programs.--(a) Notwithstanding section 1009, the13 Department of Drug and Alcohol Programs shall issue to a14 provider a license for a term of two years if the Department of15 Drug and Alcohol Programs determines that the provider meets the16 following conditions:17 (1) The provider's license is in good standing and has not18 been in provisional status for at least two consecutive years.19 (2) The provider has received a current multiyear1 accreditation from a national accreditation organization. The2 Department of Drug and Alcohol Programs shall accept a final3 accreditation report from the accrediting body, or a true copy4 thereof furnished by the provider, as evidence that the provider5 meets the applicable licensure requirements.6 (3) The process for the accreditation includes a review to7 determine whether the provider's programs and services meet8 defined standards of quality in health and human services and is9 maintained through ongoing conformance and review, including a10 survey at the end of the accreditation period to determine11 whether accreditation should continue.12 (4) The provider agrees that if the provider fails to13 maintain the accreditation, the provider will notify the14 Department of Drug and Alcohol Programs no later than fourteen15 days after the lapse in accreditation. If the provider fails to16 provide the notice as required by this paragraph, the provider17 shall be subject to standard licensure requirements, including18 inspection and issuance of a one-year license at the next19 renewal or earlier action as provided by law.20 (b) If the Department of Drug and Alcohol Programs issues a21 two-year license to a provider under this section, the22 Department of Drug and Alcohol Programs shall conduct a single23 licensing inspection of the provider for each two-year licensing24 period. The following apply to an inspection under this25 subsection:26 (1) The inspection shall constitute the required licensure27 inspection for that period and may not be conducted as separate28 annual inspections.29 (2) The scope and depth of the inspection shall be30 equivalent to that of a standard one-year licensing inspection20260SB1352PN1771 - 2 -1 and may not be expanded on the basis that the inspection covers2 a two-year period.3 (3) The Department of Drug and Alcohol Programs may utilize4 representative sampling of policies, procedures and patient5 records from the licensing period in conducting the inspection.6 (c) Nothing in this section shall be construed to limit the7 authority of the Department of Drug and Alcohol Programs to8 conduct inspections in response to complaints or other reports9 made to the Department of Drug and Alcohol Programs.10 Section 2.
